Dell may deliberately engage in delay and diversion tactics to prevent all but the most determined customers from getting their due after purchasing a Dell computer.
I've been battling with Dell for weeks to resolve a technical problem that came with a Dell computer from the factory. In this process it's become clear to me that Dell deliberately pushes its customers around, hoping they will eventually give up and go away without getting the service and support they paid for.
In addition, from all the reports here and in the media, it appears that Dell is intentionally defrauding customers during the sale with bait and switch tactics, and with extremely unfair financing terms on computers purchased with Dell Financial Services, or with Dell affiliated financial companies.
Anyone buying a Dell should do so with a credit card. NEVER use Dell Financial Services or Dell affiliated financial companies.
Do NOT give Dell your bank check.
By using a credit card for your Dell purchase you have the option to file a dispute with your credit card company in the event that something goes wrong with your Dell purchase, or if Dell violates any of its contractual obligations during the term of your service contract, which might be three years for hardware related problems.
Make sure you get a copy of the invoice BEFORE you pay Dell. You can get this online by making a copy of your Dell order page with all the details of your order, BEFORE you give your credit card number. Or ask your Dell sales person to fax you a copy of the invoice BEFORE you give him your credit card number.
Your Dell invoice should contain ALL the details of your order, such as your name and address, the computer model, each option you ordered, Dell's 30-day money-back guarantee, the terms of your service contract, the subtotal amount, shipping charges, any tax, and the grand total amount.
If anything at all goes wrong with your purchase, or if you feel that you've been cheated, I suggest you get a Return Authorization Number immediately from Dell and return the equipment BEFORE 30-days have passed from the purchase date.
If you have a technical problem within the first 30-days, it may NOT be in your best interest to try to resolve the matter with Dell technical support. Doing so might simply waste many days of your precious time, and probably get you nowhere.
You may be better off simply returning the equipment to Dell.
If you choose to return the equipment, use UPS ground, insure the shipment for the grand total amount of your order, make sure you get a tracking number, get a copy of your shipping manifest including proof of insurance, and pay for the shipment with a credit card, not with cash or check, this way you have undeniable proof that you made the return shipment, and can track it back to Dell.
Immediately after you ship the computer back to Dell write a letter to Dell in which you inform them that you shipped the computer, include the order number, the Return Authorization number, the UPS tracking number, and ask that Dell issue a refund immediately to your credit card.
Sign the letter and mail it to Dell corporate, attention returns department. Send the letter using US certified mail with a return receipt, this way you'll have proof of delivery of the letter to Dell.
After you return the computer, file a dispute with your credit card company for the full purchase amount. You do this by writing a letter to the dispute department of your credit card company. Call them to get the correct address.
Include a brief description of the purchase, the nature of your dispute, the amount under dispute, indicate that you've already returned the equipment and have proof of delivery to Dell (from the UPS tracking record at www.ups.com.)
Indicate that you've sent a letter to Dell asking them to issue an immediate refund, and that you will NOT be paying Dell's charge to your card, or interest on that amount, until your dispute is resolved.
Your credit card company is legally obligated to help you resolve the dispute, and you are not legally required to pay Dell's charge, or interest on that amount, until the dispute is resolved.
Of course, once your dispute is resolved in your favor you will not have to pay anything to Dell or to your credit card company. Disputes are usually resolved within 30-days.
Keep ALL your paperwork in a folder and don't lose anything. This is extremely important, as any missing paperwork will surely work against you.
