I purchased a computer from Dell. While still in warranty the HD failed. Dell offered to send a new hard drive and after I demanded a full refund for the computer they offered to pay to have my data restored.

NOW, Dell says that they won't pay for Data registration, and that it is now too late to return the system for a refund. They delayed the refund request just long enough to go passed the 21 day period.

Dell acknowledges the promises but refuse to allow me to speak to any management in corporate HQ or to pay me. They also insist that I return the HD with all my data on it withing 10 days or they will charge me for it.

The solicitation came by mail. The purchase was made over the phone. Will this constitute mail or wire fraud?
