This company took our application for a house rental with $90 credit check fee then emailed us next day saying they had numerous applicants so they asked for a bid war. Up bid above the listed rental amount AND give consessions "no repairs needed before moving in" and whom ever offers the most wins the privalage of renting. 

THEN they sent an email the next evening saying we didn't get the house. The owner got a better offer.

THEN the next day we get instant notice from our credit monitoring service that they pulled our credit reports. They pulled them after we were declined for the house!

This is legal? I can't see how this is legal but I wouldn't doubt it in Texas where renters rights are weak.

They gave no indication  before applying or when we conversed with 2 representaives via email before applying.

Warning: You pay and apply then Suprise! your now entered in a bidders auction for the privalage of renting a home for more then you expected with no repairs if they are needed. And you pay for the privalge and they do a hard pull on your credit after you lose.

This is unethical to say the least.

But as a condolence, they say we can still enter other bidding wars for their other properties for the next 30 days without paying again. Isn't that generous?

I think we will be consulting a real estate lawyer on the legality of this.
