I have copied a dialog between Diamond resorts international and myself.

It is all self explanatory,

Dear Poipu Time share Owners, we are all victims to what Diamond Resorts International has done. I have recently received a letter stating that all of my owner rights (I do own the timeshare) has been taken away from me as well as interest is being applied...etc. Wow...in the United States!

The Poipu AOAO Board and management company have been aware of the problem, but only learned about the extent of the damage approximately two years ago. At the annual meetings held in 2007, 2008, 2009, 2010 and 2011, and in the maintenance fee letters sent in 2008, 2009 and 2010, owners were provided with preliminary information about the water intrusion problems. Although minutes for the Informational Meetings are not yet available, the presentations can be viewed by logging into DiamondResortsHoa.com. Once logged in select "Water Intrusion Project" located on the top right corner of the page, this will then redirect you to a new page where you may select the from various links to view Minutes. Please note, at this time Diamond Resorts International does not offer a buy back, relinquishment, or resale program, and is not affiliated with any companies that aid in the resale of vacation ownership.

In order for the ownership to be sold, it must be done independently. You may contact a real estate agent, or search your local directory for timeshare resale companies. We would however, recommend reviewing www.arda.org and www.bbb.org for tips, feedback and forums discussing timeshare resale to ensure the utilization of reputable and reliable companies. Additionally, for your convenience, we have included the resale procedure applicable to your ownership once a buyer has been established. Hawaiian properties managed by Diamond Resorts International maintain First Right of Refusal. Once a buyer is established, you must fax a copy of the purchase offer to the developer at 1-702-765-8740 or call 1-702-823-7175, if you prefer to speak with a representative. If you do not have a formal purchase offer, you may send the following information to the same numbers: Owner information, Name(s), current address, phone number, fax number or other contact numbers. If you have a buyer please include Name(s), purchase price, usage beginning year and any other relevant terms. The Developer will then have 30 days to respond. If you are not contacted within 30 days, your offer has been declined, and the ownership must be sold independently.

Once the sale is approved by the resort, the original owner must complete a Quit Claim Deed ( which can be purchase online or at any Office Supply Store etc - Diamond Resorts International does not provide one) Send completed and notarized Quit Claim Deed to: Mailing Address: State of Hawaii Bureau of Conveyances P.O. To reiterate, I have never heard, seen or read anything regarding this issue until recently Billed the $2,000. In fact, in the Billing there was zero explanation and or any details as well. It would seem that no one of you at least as I am concerned bothered to inform me of anything assuming I had no rights anyway. That's frankly wrong. Dear Ms. Young,

I fail to see an amicable solution based on the below mentioned offer. To reiterate, we have already stated no way to this offer as stated in this email string. There seems to be a failure to appreciate our total cost of ownership over the many years and your (Diamond Resort International) outlandish offer to deed our property free of charge back to you to avoid so called new fees that were never disclosed to me.

I paid over $1,500 of maintenance fee's alone and therefore, bought  the week in 2011. I also joined RCI so as to secure this week since we could not use it in 2011 for an additional RCI based fee. Therefore, I already have the week from 2011 secured.

Please articulate what part of your offer is an amicable solution.

Isaak, Per our conversation, Diamond is prepared to offer you the opportunity to deed your Poipu week to Diamond. Therefore, you would not have liability for the Water Intrusion Assessment ("WIA") nor any future maintenance fees.  We would also allow to use your 2011 week, which you did not use last year (subject to availability).  In exchange, we would ask you to sign our settlement agreement which includes a confidentiality provision and a requirement that you post on RipOff report that you have reached a solution with Diamond.  We cannot offer you any additional compensation for your week.  I hope that we can reach an amicable solution based on this offer. Further to our phone discussion, there is no way we are just going to "give" away the money we spent based on your companies lack of disclosure. This money would be well spent on legal counsel. If we can not resolve this by Next Friday, I have been in contact with an attorney that is willing to handle this for us. As I mentioned to you, we are 24/7 caregivers to our son and beyond 04/06/12 will leave it in the hands of the attorney to resolve.

I am very familiar with the IT industry and will expand on the facts through postings as previously stated. I plan to update the current posting

Mr. Cloobeck,

My opinion of the terms Shareholder and Owner are one in the same. However, I do understand your point as it most likely pertains to stock related shareholders. The facts don't change and I will globally replace the term shareholder (s) to owner (s). I do appreciate you taking the time to respond and I have since received a call from Ms. Young. Had I been able to previously resolve my concerns with your staff I would have gladly done so.

Dear Mr. Cloobeck,

Please find a link to a complaint about your company. Formal complaints have been or will be sent to the BBB and related govermental agenices in your state and Hawaii regarding unfair business practices and the lack of ethical conduct (ethics). I will very soon post elesewhere inlcuding Yelp..etc.

I have attempted to find an amicable solution but your companies stance is one of the Golden rule in that you have the Gold and therefore you rule. It's unimaginable at least in the US, that any company can have such a heavy handed approach to its shareholders(owners) and think they can simply get a away with it.
