d**k Simon Trucking Simon Stinks
I was working for d**k Simon Trucking from 2/2000 until 1/2002. They didn't report the proper amount of time for employment on my DAC and then later reported that I was terminated for violating company policy. I was leasing a truck from them and my tractor was taken because of their inability to pay the bills. I however had continued to pay weekly for the tractor. Not only was I making tractor payments, I was also making insurance payments, tire fund payments, over mileage charges, qual comm payment, etc. Nothing was applied to the balance of my tractor and so in the end, I was left with the decision to either turn over the tractor or buy it out for $75,000. The orginal amount of the truck was $83,000. Where did all my payments for the last few months of my lease go??? They certainly didn't go to the tractor. So now I am out a large sum of money and have nothing to show for it. I found out in the last couple of days that Simon had not been making payment in full to their creditors starting before the end of 2001 and then in January of 2002, they quit making payments all together. I don't know how to fight or if I can fight this injustice. I am left with several thousand dollars gone down the drain and no tractor (Simon took it back on Jan. 30, 2002). Any help would be appreicated.

you neeed to contact OOIDA (if you are a member or to join and then get their help in resolving these issues) in grain valley, mo. they have worked very closely with the leaseing aspect of the industry and have many suits and litigation pending against several companies including d**k Simon Trucking, TO me it sounds like a truth in leasing law violation among others.
I am not a lawyer so i cant say for sure, But OOIDA'S number is 816-229-5791 ask for the Business Services Department.
also they are now in bankruptcy so you should contact the bankruptcy court in salt lake city to request a claim form and find out from the cout what documentation you need to file a claim aginst d**k Simon's assets.
