Facts: DIEGO FAMILY CHARGED WITH 40 COUNTS OF FIRST DEGREE THEFT AND AN EIGHT (8) MILLION DOLLAR JUDGEMENT SHARED WITH THE STATE OF HAWAII for allowing the criminal operation to operate without a funeral authority license.

Facts: *buried clients in body bags *spent clients pre-paid funeral money and *stuck you the tax payer with the following bills:

-3 defense attorneys as they plead innocent throughout the 2 years of court hearings,

-compensatory damages to their numerous clients through the Victims Assistance Unit. A branch from the county prosecutors office, and

-$8 MILLION judgement against them along with the state of Hawaii.

I am Lucille Kehaunani Mossman and I have exposed the illegal activities of the owners of Memorial Mortuary dba "Diego Mortuary" during 2001. In regard to the lies written about me from BOBBI-JEAN DIEGO: I, LUCILLE K. MOSSMAN, URGES YOU (BOBBI-JEAN DIEGO) TO SWEAR UNDER OATH OF YOUR ACCUSATIONS WRITTEN ABOUT MY CHARACTER WITH THE PENALTY OF PERJURY.

The DIEGOS are about "Theft, Embezzlement, Deceit, Fraud, Elderly Abuse, etc".

As of: Sept. 2, 2003:

1. RobertDiego is facing 10 years. His plea was "No Contest" to First Degree theft.

2. Momi Diego is facing 1 year plus 5 years probation. Her plea was "No Contest" to First Degree theft.

3. Bobbi-Jean Diego is also facing 1 year plus 5 years probation. Her plea was "No Contest" to First Degree theft.

4. The current amount of funeral trust plan money that they are charged with stealing is ($500,000.00) FIVE HUNDRED THOUSAND DOLLARS!
THE DIEGO MISSION WAS TO STOP THE AUTHORITIES TO BELIEVE THE TRUTH FROM ME.

This family (Diego's) of thieves has assassinated my character so that they might succeed at persuading the public to not come forward in seeking restitution regarding their missing funeral plan money and also for burying their loved ones inhumanely. This is a small town and many of the families have fallen victim to their lies such as: "We're Innocent", "Diego's former girlfriend made it up"..."don't believe her, she did it because my dad wouldn't marry her" and so on. (With a bit of street tactics and a clever "criminal defense/corporate attorney's help and expertise, their tactics assisted them (Diego's) from "NOT" receiving a longer jail sentence and "NOT" having to pay a larger amount of restitution to their customers. The actual figure that was stolen from the community could possibly be well over One Million Dollars.

Bobbi-Jean Diego and her family consist of "Low Life Gutter Street-Level Tactics and the old saying applies to the Diego Clan: "If we can kill the messenger, then we can kill the message"

As for the brave souls who did seek restitution and came forward to the authorities and reported the atrocities, hats off to you. You did what was right. o (Momi Diego, Bobbi-Jean Diego and Kenneth DeRego) Endangering my son's life by nearly running him over 10/14/01 in Ainaloa Subdivision.
o Harassed by police when requesting assistance
o A radio commentator "Waltah Pacheco" claiming over his radio station air waves that the building that I live in will be burnt down
o Harassed by a Portuguese postal working that I am having an involvement in Anthrax and he (Gary Cruse) threatens to have me investigated with the United States Postal Service
o A dozen plus letters sent to the C.P.S. stating that I am a drug addict and I beat my children and they are always scrawny and bruised.
o Letters to the housing agency that I am a known drug dealer and I should be evicted
o Letters to my landlord claiming that I prostitute myself and bring "John's" into my home for sex and drug activity.
o Threatening letters to my employers stating that they will be sued for having me employed
o Threats made to my sister by Mr. Diego that he would have me killed.
o Dragged in and out of court by their "Corporate Attorney Brenda Carreira" for False TRO's made up by their employees and wives one of which is a convicted sex offender.
o My vehicle tire-lug nuts loosened with the wheels ready to fly out ...
These incidents have been filed with the Hilo Prosecutors Office and the Hilo Police Department.

What alot of people on the Big Island did not know is that Mr. Robert R. Diego and his family
were the victums of an evil women who's thought of revenge is to say and do things that are untrue. Lucille Mossman should look at herself and the company that she works for which itself was under intensive investigation from the Department of Commerance and Consumer Affairs as well as the State Attorney General's Office back in the 1980's for failure to maintan the cemetery park that was at times with no running water, rubbish cans overflowing with trash, grass so high that you needed a cut cane knife just to find your loveones grave. As quoted in the article dated 6-22-1984 by the Hawaii Tribune Herald. "Once, she said, a body was stored under a shed for two days becuase there was no cement blocks for burial" as stated by Linda Souza in this article. Also Helene Hale also stated in this article that it took her three hours to find her fathers grave, and that the grave was virtually lost in the weeds. These and many other problems for this cemetery began in 1980 when a Florida man, Mark Fellman, was in the process of buying the cemetery from the C. Duane Carlsmith family Trust.

Mr. Diego himself tried to purchase this cemetery because he too had his family buried there. Mr. Diego at that time stated in the Hawaii Tribune Herald article dated 6-21-1984,
" Robert R. Diego, funeral director and manager of Memorial Mortuary, said his company woould assume all liabilities and inherit the ownership if the state approves his plan takeover. mr. Dieo had the backer to help him bring the park back into shape. This deal never went thru because of the numerous complaints filed against this cemetery and Mr. Diego rescind his offer after several months.

Some of the numerous complaints filed at that time were that ome of the graves were sinking. Some have been "Lost" because the burials since 1980 have not been registered. No accurate records were every found to list the burial sites of many love ones there. The grass is seldom mowed, grave markes are frequently damaged. Even local mortuarys at that time stated that they too were "Embarrassed for their profession, dread conducting funerals in the park". One funeral director stated at that time" I never know is the grave will be dug until I get there with the procession." Another
disquested funeral director at that time stated
"All we hve is a phone number to an answering
service...and that number has already changed three times".

Mr. Fellman the last owner of this cemetery was a mainlander who came to Hilo in hopes of buying the cemetery. With a scheme of offering cheaper
burials by using plastic coffins. Mr Fellman has not been able to be found since running off with the money from the cemetery and only after doing some of these so called cheaper burials using plastic coffins.

With all of this stated I think Lucille Mossman should look at the company that she now works for and stand back and think for a moment of the horrable true accounts of the company that she works for. And yes to anser he main question, yes the so called remains found in the body bags were all buried at this cemetery that Lucille Mossman now works for. When any of the Mortuarys place there casket onto the lowering device at any cemetery, it then transfer the liabilty over to the cemetery to make sure that the casket is buried and not distrubed in any way shape or form. Why is it that the two familys that were listed on the search warrent were they stated upon disintering the grave they were shocked to find there love one incasted in plastic and laying on the bare earth. Did you all kknow that when these bodies were found in the 80's or 90's they were disintered from Mauna Kea Memorial Park and that not one of these familys called to police to report this crime or even contacted our mortuary. Why is it that when Diego ends his relationshiop with Lucille Mossman she then uses her own vcompany to state to the State Attorney Generals Office under oath that she saw Mr. Diego do 4 or 5 illegaly embalmings at our mortuary. So why can she remember if it was a female or male, hair color, time of day that she so called witnessed this and most importantly what was she doing inside this room when an embalming was going on. She is not a licensed embalmer or even a licesed apprenticeship embalmer, isn't she breaking the law herself?

Lucille Mossman does not realize that when a man says it's over it is over. Lucille Mossman is in her own world where she thinks Mr. Diego will come back to her, but she is serously wrong. Mr. Diego has since moved on with his life and is very happy to not have Ms. Mossman in his life and only wants Lucille Mossman to get on with her own life and stop harrashing him and his immediate family with all of these nonsense police reports of alleged harrashment that she claims has happen. Lucille Mossman as she is now known entered my fathers life about 8 years ago as she was known then as Denise Mokiao. At first we the family didn't not approve because of the fact that she had gone thru some name changes in the past because of unpaid utilities bills. I latter learned that she once stabbed another person while in high schoool because she didn't like the way that person looked at her.

Lucille Mossman had a bad habit of always running away from her problems and dumping her daughter Rebecca and her son Luka with her mother while she went to Las Vegas to get married as she stated to a funeral home owner's son, but that family did some back ground check on her and the wedding was called off. So were
did Lucille Mossman go, back to Hilo, Hawaii to reclaim her children from her mother because she needed the welfare money for herself.

my father finally gave her a last chance and told her that she needed to settle down and take care of her children, of which her eldst daughter was already known at the police department because of variouse juvinile pranks that she did just to rebel against her mother.

My father was shock to learn one day from Luciile Mossman that she was know three months pregnant and told my father that she did not want this child and thought about having an abortion, my father told her that he would give her one more chance and help her get off of drugs but she needed o want it for herself. At first it was O,K, but into her pregnancy she was back to her old self where my fathe was always dishing out money because Luciile needed to have her hair done all the time and there was no end to this. At times when my father would tell her that he didn't have any money, she would threaten
to say bad things about him to agency to close his business down.

Lucille Mossman even tried to sign my father up for a 250K life insurance policy and name her the beneficier of this policy so that she can use he money to take care of there daughter, who
was taken away from her and put into a loving home, because Luciile Mossman use to leave my baby sister in her playpen all day sometimes without food or even changing her diaper because she had her guy friends over at her house drinking and smoking. My brother and sister put a stop to that, which made Lucy mad. When my father gave her $ 5000.00 to buy the baby some things she turned around and used that money to enhance her boob's thru a maui doctor and my dad had to go out and buy the baby her car seat, clothing and other items that a 2month old would need. Lucille Mossman was also recieving assistance thru the WIC federal program that gives mothers vouchers to pick up infant formula
which costed about $350.00 a month. Lucy would turn around and sell this formula to people for money knowing full fact that her 2 month old daughter would need this formula herself. Lucy
then told my father that she didn't qualify for this program and he would go out and buy the formula for his daughter. I finaly convinced my father to go and ask the lady at the WIC program and he was shock to learn that Lucille Mossman was always recieving the infant formula she claimed she never got. My father then took her to court and put my baby sister into her aunts home for protection because Lucille Mossman was deemed unfit by the court.

lucille Mossman then tried to get my father to divorce my mother and marry her and adopt her two other children that she had from two differant guys. My father told her no way to her recent demands and she told him that if he didn't do this she would go to differant agency's and tell them that he stole peoples caskets and put there love one's into body bags and resold there caskets. My father by then was so disgusted by her demands he told her to get out of his life and he never wanted to see her again.

In December of 2000 Lucille Mossman started posting filer's up around saying that Memorial Mortuay/Diego Mortuay Inc & West Hawaii Mortaury did not have a mortuary license, that we lost our property on Waianuenue Avenue because we didn't pay our property tax, that Mr. Diego is not a licensed embalmer and that we have no embalming room at our present location (202 Maka'ala Street) and that we were selling un licensed funeral plan and spending the money,etc.

Lucille Mossman then started to put these fliers into people mail boxes which is a federal offense and she was told by the head postmaster that he would charge her 35 cents for each flier that was brought into his post office, which came out to just about 300 in one month period.

Lucille Mossman even picket our place of business on a saturday morning claim just for the citizen of Hilo. Remind you that while she is doing all of this knowing that my father has a TRO against her.

Lucille Mossman once came over to my auntys house late at night demanding for money and when my father said no she started to physical hit my father on his chest and scratch him, and that is when my aunty told her too leave and when she went for my father again my aunty step in and physical restrained her until the police could arrive and remove her from the residence. About an hour latter my father and aunty heard a child voice or crying and when they went out to her car there was my baby sister and her brother in the back seat of the car. Lucille Mossman was so worried about herself that she didn't even bother to llet the police man know that her own children were in the back seat of the car, remind this is late at night and they were in there P.J.'s yet wondering were there mother was.
This women is a unfit mothet who should have her reminding child Luka taken away from her because she is a bad influence to this boy by teaching him to lie.

Lucille Mossman called the police on my brother one day to say that my brother passed by her sons school and gave him and his friends the evil eye and shouted at them. My brother was at his County Building job and had department heads
give statements to the police officer to say there is no way he could be in two places at the same time. My brother filed a false report against Luka Mossman and his friend, remind you this boy stated to police that it was my brother but could not identify him or even state the facts of what happen, his mother Lucille Mossman did most of the talking. Lucille Mossman's case against my brother was dropped due to lack of evidence. Lucille Mossman and gher son Luka Mossman will need to go to family court to answer to the charge of false reporting.

As for my family and I we all know that someday god will punish those who do harm to others. Memorial Mortuary/Diego Mortuary and West Hawaii Mortuary were cleared of the the body bag's and the stealing of caskets as stated by State Attorney General Ricky Damerville and published in the Hawaii Tribune Herald (Dated 12-6-2002)

dated( 12-6-2002) the only charges that my family and I have are the 38 counts of theft and when we go to court sometime in March we will prevail. My family and I are in the process of filing a lawsuit against the State of Hawaii, Lucille Mossman and all indivual's who were in the search warrant that stated my father stole there love one's caskets.

Just a fact to add on to this story is that the people who claimed to have had there love one's casket stoolen all happened to be buried at Mauna Kea Memorial Park which is the same company that Lucille Mossman works for as a volunter because she is receiveing public assistance and does not recieve and money from this job and only works tuesday's and thursday's when the boss is in town. I think that we all most look at ourselves before casting judgement on others.

November 2001, they were able to obtain $19,000.00 and was able to build their embalming room. Now they do not have to send bodies to Oahu at Leeward Funeral Home for embalming. They were issued a Dept. of Health "Mortuary" license. Consumers were not made aware of this cost of shipment. They were told that the bodies were being embalmed at Hilo Hospital until they get their emblaming room built.
