Got scammed by Direct TV and wanted to get out of the contract but they asked us to Subpoena the recording. I know for a fact that I never got a call from a third party to accept terms set by Direct TV. 

To get out of the contract it would have cost us $480 and the Subpoena to request the recording is $600. Direct TV knows that no customer is going to request the Subpoena due to the cost. All I can say is buyer beware and avoid Direct TV at all cost. Its a horrible company and the customer service specifically called me a Liar on recording and what I asked the manager to review the recording he said they dont record all of the recordings. Shame on this company!

If you are 100% certain you didn't agree to the terms, then sue them in Small Claims Court.  In order to prove you did they would have to provide the recording.  If they can't provide the recording you would most likely prevail and most likely get the Early Termination Fee and your court costs.

However, before you do that realize that if they do have a recording and it does show you agreeing to the contract, you will loose not only your case, but be out the court costs and they may decide to counter-sue you for things such as attoney fees or the fees it took to get the recordings.

So just how certain are you that you didn't agree to any contract?
