Complaint Review: Discount Blind And Shade Factory

I have had several e-mails and voice mail messages from Mychael at Shoreline Shutters. This man is sincere and is very very upset about what all of us are going through and most likely will continue to go through. As I read through some of the other rebuttals, it is uncomprehensible to me that Ken and Kristen can just go along their merry way, trampling over us, start another new company, and think that they do not have a care in the world!! At this point we can write each other all of these suggestions, e-mails, rebuttals, etc., but we have to take immediate action and take it now. What we should be looking for is an attorney that will help ALL of us file a class action lawsuit against these crooks. When I read the comments of the sales person of Discount Blind, I can believe what he is saying, because when one of the so-called "installers" were at my home I overheard him say to Stephanie on the phone that he wanted his paycheck today and that it "better not bounce this time!" Getting back to Mychael of Shoreline, he has offered to ALL of us who lost money and/or shutters his help. He would provide to any of us that want to, to let him know first if your order was with Shoreline; second, if you want to continue the process of putting shutters in your home, that he would sell them to us at cost! In addition, George & I would work with anyone on the installation of these shutters. George is in the home remodeling business and is very qualified to install shutters. I know what you all must be thinking -- why didn't you just go buy them at Home Depot and have him install them?? I'm kicking myself every night over that same question. Please think about it. Mychael can be reached at Shoreline. Their phone number is: 1-800-317-9315 ext. 225. In the meantime, we will try and contact an attorney friend of ours who specializes in corporate issues. Some of you have asked who "P" is. You will note that she has sent in very important info for all of us. She just signs as "P" so at this time I cannot betray that confidence.

Don't forget to call Tom Allen's office (atty for the BK) and get on that list. It is very, very important. Protect yourself anyway you can from these thieves.

Please, please, don't give up. That's what happens, people give up and companies just keep on hurting and stealing from innocent people like us. I think the "billboard" idea is great!

Thank you for all your updates. I've been out of the loop a little my in laws are in town! I will let you know what "Sherry" has to say about 'poor Kristen'.

ATTENTION ALL: I spoke to "Sherry" in Tom Allen's office (Attorney for DB&SF) to inquire as to whether or not they had proceeded with the bankruptcy. Per Ken's statement to Judge Strickland on 1/19/06 at our hearing, he put on the record that they were filing bankruptcy on Tuesday, January 24th. Well, guess what? According to "Sherry" they have not filed that bankruptcy. I asked her why not and she said that "poor Kristen had to go through all of the invoices and provide their office with all the names and addresses of proposed creditors"!!Poor Kristen!! I told her what Ken had stated to the Judge and she said that they had "planned" on filing on Tuesday, but they had not. I asked to explain the process of filing as a creditor and she said that when the bankruptcy is filed each creditor that IS ON THE LIST provided to them by Kristen will be notified, we then have 90 days to file as a creditor to try and recoup a portion of our money. She continued to say that they will base the list of creditors on what Kristen provides to them. Holy Cow!!! I asked "Sherry" if she was aware that Discount Blind and Shade has opened a new business under "US Shutters". She said she would not comment on that.

Basically, everyone of us has to call the office of Attorney Tom Allen at (602) 256-6000 and ask for "Sherry". You must be sure that your name, address and telephone number are provided to her. We cannot depend on Kristen to do this for us. So please, call and call now. Be sure and get your name on that list.

I'll keep you posted when I received our decision. When I spoke to the OAH yesterday (1/24), they told me that the signed Order is sent to the ROC and that the ROC has 35 days within which to notify us of the Judge's decision.

Love the Shame idea. In fact, I just saw an SUV sporting a complaint against a large pool company (to go unnamed here) IN Scottsdale on the 101. This traveling BillBoard will be seen all over the metro PHX area--what a great concept! Poster Board or a bar of soap on the rear view will look like ****, but is a very effective way to get the word out on these THIEVES, and hopefully save others from becoming their victims.

Hey Marie and George, thanks for sharing your experience with the ROC. Sure goes to demonstrate the sneaky, conniving con artists these people truly are. Can you share who Peggy is? SOmeone from the ROC?

We originally contacted Channel 12 directly through their website.When I received a response it came directly from Rick Debruhl. His e-mail address shown was just "Debruhl, Rick". Please try and contact Channel 12 first and you'll see how to contract Rick.

We are also waiting to find out how to join this class action lawsuite. I've contact Mychael Margott of Shoreline Shutters (the manufacturer of ours) and am waiting for his reply. According to other posted messages, he is willing fund this lawsuit for us.

With all of doing this, DB&S doesn't have a chance and neither does Kristen and Ken. Perhaps, we will see them suffer as we have if all goes well.

I believe we have been using the wrong box to update everyone and for that we apologize. We had our hearing with Judge Strickland on January 19, 2005, and to our surprise Ken and Kristen did show up! These hearings normally go for about 1-1/2 to 2 hours. We were there a little over 3 hours. To make a very very very long story, short they both sat there and blantantly lied to the Judge. We objected as much as we could, presented our entire case and an Order will be mailed to us. However, Judge Strickland did say that DB&S were in breach of the contract, but that we would not be getting all our money back, but he he would send it to us in writing. By this time all of us are aware that Ken & Kristen are fiing bankruptcy. That was to be done today according to what Ken told the Judge.

It surprised me to see your posting given the fact that your order has been installed and we have an appointment with you and the Registrar of Contracts to address some of the concerns about your installation.

Marie, given that this is the third or fourth order and your husband did contracting work on our showroom, it really surprised me to see a very misleading posting.

Hello All,

I recieved a call from the Roc of Arizona today, he indicated to me that I would have to deal with the California office. He did state that he has over 30 complaints on file and is trying to
do everything he can for us.

He also stated that he faxed over my info to Ken Montoya directly. He said that he recieved a response from Kenneth stating that my shutters were in the process of being shipped COD. Ken also stated that Discount Blind had to close, so I would have to contract out someone to install them. However I still would need to pay the entire balance. Of course, no date was given as to when my shutters would arrive.

My husband and I did submit our info to the Roc of Ca. I wish you all good luck at the meeting, and wish we could afford to drive out there and be with you all.

I will keep doing all I can over here in California, there is power in numbers!!
