I am ABSOLUTELY APPALLED with Discover Card. Where on earth do they get off on pulling up my credit report and call up my parents all hours of the day AND night and harass them for over TWO WEEKS NOW. And on top of that, where does Discover Card get off on discussing my account details with my parents or with anyone else for that matter? Discover has NO RIGHT and NO BUSINESS to do this. These are TOTAL VIOLATIONS of the law for business practice. And WHY is Discover Card HARASSING my parents instead of calling me?? I don't know. I DO NOT live with my parents. Discover HAS my number AND my address.

The two employees from Discover Card who keep harassing my parents all hours of the day AND night is this woman who uses the names of Krystal, Kristen and Stephanie [It's the same woman who uses different names to try to fool someone]. And this arabic sounding man who said his name was Hadeem. This Hadeem swore at my parents on the phone. This Hadeem and Krystal [Kristen, Stephanie, whatever the hell her name really is] are rude beyond rude in terms of asking all sorts of personal questions that have NOTHING to do with my account at Discover. My parents HAVE REPEATEDLY told Discover Card on the phone to CEASE AND DESIST calling and harassing them and that to call ME instead. Discover Card is STILL harassing my parents all hours of the day AND night AS OF THIS WRITING.

All of this harassment and violations just because I made a couple of late payments. I am THOROUGHLY DISGUSTED. I am beyond sorry assed that I ever had gotten a Discover Card. I wish that I had NEVER opened an account with them. NEVER. They rather violate all laws for what? It's CRIMINAL and SADISTIC what Discover Card does.

Anyone who has an account with Discover and is reading this, you would be VERY WISE to CLOSE your account IMMEDIATELY, and RUN AWAY from Discover card. I will seriously CLOSE my account ASAP. I will also be filing whatever criminal complaints are necessary, as Discover Card NEEDS TO BE PUT IN THEIR PLACE! Discover is JUST AS BAD as bofa [Bank of America] in my view. How they manage to stay in business is beyond me.

I have to agree that Discover Card's practices are incredibly shady and inexcusable.  My mother holds an account with them that she fell behind on in the course of losing our home and all the moving and so forth, but she kept paying them monthly.  Then they suddenly drastically increased her minimum monthly dues.  She could no longer afford it.  She tried to work out something with them over the phone, but they were not helpful in any way.  And then the harassing phone calls began.  Many times a day, up to and including 9 pm.  It's been going on for months. 

They contacted her brother in Texas (we live in New York) about her debt.  She said she never gave them his number. 

My mother and I live together and the phone is mine.  I pay for it and it's in my name, so I resent essentially paying for phone service that lets ME be harassed day and night by a company I have no dealings with myself.  And yes, even though they are trying to reach her, constantly having them call feels like harassment towards me.

I have intercepted a couple of these calls and told them I want them to stop calling at this number and why.  They apologized and said they wouldn't anymore.  That lasted about a week.

I wrote a "cease and desist" letter to them, to no avail.

What's more, I actually receive between one and two credit card offers from them in the mail every week.  I Return to Sender.  Let them pay postage twice.  I'm fed up with these people and I never even had an account with them myself.

Discover appears to be handling their own debt collection.  It would seem, if that's so, they should be held responsible for their actions.

On the site FairDebtCollection it states (and I am only putting the ones relevant to the original poster's case):




A debt collector MAY NOT (despite what they say):


Contact a third party about your debt for any purpose other than to locate you.


Identity the debt collection company name to a 3rd party without being expressly asked.


Disclose to a third party a debt is allegedly owed.


Communicate with a single third party more than once.


Communicate or attempt to communicate with you at inconvenient times or places.


Contact you at work after being told not to.


Communicate with you after receiving a letter from you (a) with a request they cease and desist all contacts or (b) that you refuse to pay the debt.


Engage in harassing, oppressive or abusive conduct.




Cause your telephone to ring repeatedly or continuously.

Continue to contact you after receiving your cease and desist or request for validation letter.


I don't know how it is where you are, but in New York, they are supposed to stop calling after being sent the "cease and desist" letter (it was called this even on a news report I saw recently discussing consumer rights when being harassed like this).

I wish you luck in your dealings with them.  Fortunately, I don't have a debt with them, and will never sign up for one of their cards now that I've seen how they act.

Nikki,

There is NO SUCH THING as "cease and desist" in debt collections.

Just READ the law. This would be the FDCPA.

The EXACT verbage from the FDCPA is "CEASE COMMUNICATIONS".
NOWHERE in the entire verbage of the FDCPA is the term "cease and desist" used.
Nowhere.

I don't care what Wikipedia says. They do not make laws. They do not enforce laws. They are not lawyers either.

Wikipedia takes contributions from Joe Blow average citizen, and this is where your bad information is coming from.

As far as them pulling your credit report, that is perfectly legal.

As far as them calling your parents, you must have listed them on your application or on the account itself. Otherwise, how would they make the connection?

As far a "cease and desist", there is no such thing, especially as they are not third party colllectors, so the FDCPA does not apply. If it did, the term would be "cease communications"

You are obviously avoiding them, and that is the reason they are calling other people, like your parents.

Your parents do have the legal rigt to stop the harassment. They need to send a demand in writing. They need to explain clearly that you do not live with them, and they are in no way responsible for the account. They need to make it very clear that they never want to be called again.

This letter needs to be sent by certified mail, return reciept requested. Be sure to put the certified# on the letter itself and keep a copy for your records.

Then, after they reciece this notice, if they keep calling, your parents can file criminal harasssment / stalking charges. They must keep a log of the date and time of all calls.
