DISH Network Lied about their promotion. Charging for equipment advertised as free and violating their contract. Englewood, Colorado

I signed up for a DISH promotion at a Blockbuster in Arizona.  At the time, I told the representative I was planning to buy a new TV and would be upgrading to HD.  He told me that would be no problem and that my bill would only increase by $10 - or I could do it by automatic withdrawal and there would be no charge at all.  He stated there would be no charge for the hd box.  He also told me that at the end of a year, I could call Dish and get another year at the same rate.  That rate is 250 channels for a total of $53 including dvr.

A few weeks later, at Christmas, I got a new tv and contacted Dish.  I asked the representative again if there would be any charge for the box and he replied "Absolutely not."  Just an increase of $10 per month which was acceptable since I did not want them to have access to my bank.  I received the HD box and returned the original box.  Imagine my surprise when I received a bill for $123.00 to cover the cost of the HD box - AND to learn that my contract had been cancelled and now I would be charged full price for my service instead of the promotional price.  My contract stated nothing about the contract being voided if service was upgraded.  Needless to say, I would never ever have done such a thing.  They are threatening me now stating I will be charged for the remainder of my two year period even though they violated the contract.  They claim I did this over the phone but they have no proof that I did.  I do have proof of their statement as I recorded the whole thing on tape with their rep confirming NO charge for the box.   I am not by any means done with this.

I'm glad to hear the monthly rate has been restored, and the receiver charge was taken care of. If you require any further assistance or have any questions please feel free to contact me, and I would be more than happy to check it out!

I have already dealt with this.  DISH retracted the charge for the hd box, but they neglected to remove the other charges associated with the box and still have a $23.00 charge which they say is for taxes on the box - which I never was to pay for in the first place....so that makes no sense.  They finally restored my monthly charge to its original rate but I cannot drop this service without a penalty so I am stuck.  I will terminate it as soon as possible and will never do business with Dish again.

Elizabeth,

I can definitely understand how frustrating it must be. The cost for upgrading our equipment is based on many factors from an account. The upgrade can be free, discounted, or full price. It sounds like the plan was discounted, but I can definitely look into that further with you.

I would have to look at the account to get information on the upgrade and contract. I can look into what's going on and provide more information. If you send me an email at thomas.faust@dish.com I would be happy to help!
