I ordered the Think & Lose Program. The only reason I ordered it was because the TV infomercial advertised that I would not have to pay until 30 days and the shipping was also free as well. Minutes later after placing my ordering, I changed my mind about the program and I immediately called back to cancel the order. The customer rep said that I needed to call back the next day because it takes 24 hours for the order to be processed into the system.

After sleeping on it, I reconsidered and decided to let the order be processed and shipped to me and try it out; especially since I did not have to pay for it right now. (Again, this is the only reason I ordered the program in the first place because I would not have had to pay until 30 days later). A few days later, when I checked my account , my account read $-144.97. Think and Lose did not honor what it advertised regarding no payment for 30 days and debited my account for the $52.90 payment for the program. My bank charged my account $35.00 NSF three times ($105.00 total). The bank charged me $35.00 for $52.90 and $70.00 more dollars for for two other small transactions which I had more than enough funds to cover prior to Think & Lose debiting my account.

I sent them a fax explaining in detail what they did, along with my bank report and my bank representative contact information who also confirmed that Think & Lose caused my account to be overdrawn. The bank report showed my beginning balance prior to Think & Lose debiting the $52.90. However, because they debited my account (as they advertised that they would not), they caused a chain of overdrafts events.

In good faith, I trusted what they advertised. I trusted that they would not debit my account. I knew what I had in the account, and if I thought in anyway that they were going to take the money out prior to the 30 days, I would not have called and ordered.

I spoke with cust. rep last name - Escobar, a supervisor in customer service, I told her that I attempted to cancel the order a few minutes after making the order. She told me that once I made the order, I could not have stopped the order whether I had called back the next day or not. She was nasty and said that they are not going to refund me the NSF Fees. I am angry, and for all who have been scammed and deceived, we need to come together and file a class action suit. I dispise unscrupulous businesses and business practices. And if Don Mannarino is aware of how these people are representating him, then what does that tell us about him????

I ordered the Think & Lose program too. They sent my CD's to the wrong address. It took two additional weeks to get it. I returned the product because Mr. Mannarino essentially shouts for approximately 30 minutes to eat half as much food as I normally would and that is the program. This is NOT hypnosis. It is crap. After numerous phone calls and months of waiting, I finally called my bank and they credited my account. These people are total scumbags. Buyer beware!

I agree with the orginal consumer. This company is set to take advantage of consumers!!! Unlike the consumer I did everything over the phone. So no one can say I'm lazy and did NOT read! Like the original consumer I also changed my mind and called right back to cancel the order and the same answer was given. I would have to wait 2-3 days for the order to process. On July 17th, 3 days later I called to cancel the order as instructed by the CSR on July 14th. CSR told me that the order had alrady gone out and to return the package upon receipt. I would be responsible for shipping charges. This call lasted 3 minutes.

One week later I received the package and went straight to USPS to return the package. Since the package was never opened all the post office did was return to sender. The same label number was used to return the package. So convenient for "Think and lose" not keep record of their own shipping labels as they are sent out. Now the package can't be tracked and is nowhere to be found. I bet it's sitting in their mailroom along with the other hundreds of returned orders that have not been processed yet.

Sept. 12 received 2nd package, called CS dept. and was told that I never called to cancel. Funny how I have my cell phone bill with records of the call that lasted 3 minutes. What else would I have called for 3 days later after I placed the order other than to cancel. I was also told if I had called to cancel the CSR would have told me to obtain a tracking number. This was never instructed, after all, the call only took 3 minutes, how much more could she had said to me other than return upon receipt. Now I'm being charged $50.92 for the initial 30 free trial that I cancelled 3 days after placing the order because according to them I didn't call to cancel. And also I'm being charged $48.80. for the pills because since according to them "I never cancelled" they sent me the 2nd order. My credit card was charged for both on August 31st, 6 weeks after I had called to cancel and 5 weeks after I returned the original 30 free trial that was never opened.

Now I'm told that these charges are not refundable. 1st because they never received the 1st package. They say since I didn't call to obtain a return confirmation number (which I wasn't even advised to do when I called on the 17th along with the failure to obtain a tracking number) the return process could take up from 6-8 weeks. Well guess what? Today is Sept. 16th. It's been 8 weeks! So why wasn't the returned package processed? 2nd, according to them, the call on the 17th was not to cancel.

My next step is to file a complain with the Division of Consumer Affairs along with the Better Business Bureau. I have a call history as well as recorded conversations with CSRs that have been reluctant to help me. If all this fails I will proceed to seek legal action with Small Claims Court. They are refusing to access the call I made on the 17th to cancel as every call should be recorded for quality control purposes, I'm absolutely confident that that recorded call will confirm that my only intentions were to cancel and my request was not honored.

Will not lose,

Read what you're being offered and you won't get ripped off. This is YOUR OWN FAULT!

I went through the entire on line ordering process that you did, and I can clearly see that if you are lazy and don't read what you're clicking, you are going to get charged more money and right away. They are doing nothing wrong except to inundate you with additional offers. It clearly says throughout the order process, right where you click to agree, that if you accept the additional offer of other items, you will be charged right away and that it costs more. The only way to get the free 30 day trial is to hit "no" to every additional offer they give you. I did it, and it was EXACTLY as they advertised. I even called to return it at 25 days, and it was as easy as they said it would be. They asked me one time why I wanted to return, and when I said it was because I didn't have time to listen as often as I needed to, they offered to extend my trial period before charging. I said no thank you and they gave me a return number and never bothered me again. I never saw a charge on my account or got any hassle from them.

Oh, and in regards to trying to get a refund after the order has already gone to the warehouse, it's very difficult. I used to work for a company that sold product on line and over the phone. Once the order gets sent to the system, it isn't easy to pull it back. It's often sent to a completely different building and likely another company altogether. They aren't trying to scam you. It's a logistical issue.

So, READ what you're agreeing to. Of course, they are going to try to upsell when you order. That's the job of a sales company. It's a little extreme, I agree, but that's all they are doing. It's not a crime. And they certainly know that there are a lot of morons out there that won't read what they are saying "yes" to, and they can get more money out of them. It happens in almost every sales arena in the country. Don't blame them. Blame yourself. Stop pointing the finger and start pulling the thumb.

By the way, I reordered the product later and have lost 7 lbs on it. It works, if you listen every day.
