I was not making a lot of money on my job when I first got the car from drive so I was excited at the opportunity to have a car in my name so I jumped at the offer back in sept 07. I made a move to another state which led to me getting behind on my payments by 4 months. I woke up one morning and my car was gone. I immediately contacted drive and they informed me that the car had been repossessed and that I had ten days to get it back. Immediately I started gathering the funds to pay. I talked to someone on tuesday letting her know that I would pay the balance in full the next day and she said okay. When I got to the money gram place I called one more time to finalize everything. The rep told me to go ahead and pay and once they get the reference number they would release the vehicle. I sent them 1500 dollars and they gave me the repossession location and number. I got the run-a-round from this guy for about an hour and a half before I found out they had sent the car off to the Adesa Dealer auction. I found out that they sent the release for this vehicle to be sent to auction since June 30. So they already knew the car was being sent to auction and still took my money. When I got to Adesa to get the car drive informed me that they would not release the vehicle. I tried everything I knew and I plan to go to small claims court in the morning. If anyone knows anything I can do about this please contact me because as of this morning I am out of 1500 dollars and still have no vehicle to show for it!!!! I am VERY interested in filing a lawsuit against this company for not allowing me the ten days they agreed to in order to retrieve the vehicle as well as all the lies and unethical treatment since I had this vehicle.

You bought this car in September of 07 and in June 08 you were already 4 months behind. If so you had made no more than 4-5 payments. So there is no way your PAYOFF was $1500 that was the back amount due.

The 10 days they mentioned was the time to totally pay off the loan, not just the back amount. A company is under no obligation to return your car unless you pay off the balance. You are also very lucky that they let you slide for 4 months. Most companies Repo the car as soon as you go 3 months behind(some even sooner). So you got an extra 30 days out of them.

You did get something by paying the $1500, that is less money you still owe. Because even though they Reposessed the car YOU are still responsible for the difference between what they sell the car for and the balance on the loan.

Take this as a life lesson. Don't get something you can't afford and do think you can get your $1500 back. If you go to a judge with this case you will be laughed out of the court(or have a nice 30 minute sermon by the judge basically telling you the same thing)

That is not to say that there won't be a lawsuit. However, YOU are going to be the defendant when they come after you for the balance from the loan if you don't pay it totally off.

why were you 4 months behind if it only took you less than 10 days to get 1500? why didnt you just do that when u were 3 months behind & be ahead one payment so u wouldnt have your car repo?
