I fell behind on my car payment once me & my husband seperated. When this first happened I was harassed by a Bob in Dallas. He called me on several occasions at work mostly, talking rude and smart to me. He left several messages on my work phone saying that I know I'm at work and whatever it takes he will get me. One time a young lady filling in for me answered my desk phone and he told her you know you're the person I want stop playing silly games with me.

Ok, the situation I'm filing a lawsuit about now is dealing with a young man name, Eric Frost, he got a hold to my mobile phone statement and called everyone I have called from my mobile phone and harassing them about me. He had told several of them that he's looking for my car and that I know I can't afford to pay for it. Than he told one young lady that just tell us where the car is now, we'll take care of the rest. T

hese individuals have called me asking me why did I give him their personal mobile numbers in which I told them I did not. When asked how did he get the person's number he would say I put them down as a reference, WHICH IS A LIE, 11 of the individuals he have called, I have only known them for the past month or so. At that point they told him you're a liar, she had that car when I met her. These people informed him to stop calling them and he continues. I know this is against the law for them to do this, and that's why they only have just begun with me.

CONTACTING PARTIES ON CELL PHONE

I am sorry to report to you that the company obtaining your cell phone # and information on your bill is a regual business practice of many financial institutions, but is legal as well.

First, let me state, I know it can be disarming that people are contacting you regarding a bill or financial obligation. However, these companies have your premission from the time that you sign the inital credit application to the time that you sign the contracts; these documents give them the right to investigate you and make contct thru whatever means necessary, if they feel there is a true need and the necessary contacts are not disclosing all of the information that the creditor feels that they may know.

These companies hire 3rd party, private investigations companies, to use their resources to obtain information, i.e. your cell phone # and billing information as well as copies of your actual bill. These compaines obtain their information in a variety of ways, through data bases that allow them access to other company records, or the old fashioned way....they have a friend or contact on the inside.

With the new "GLB" laws that were put into effect, the information that is obtainable has been severly limited. Which causes creditors to resort to other means of contact. It is also legal to contact your friends, family, boss and neighbors, AS LONG AS THEY ARE NOT DISCLOSING THE NATURE OF THE CALL, OR MISREPRESENTING THE COMPANY THEY ARE CALLING FROM.

Now, what your friends, boss or family members make of the phone call is a different thing. These companies cannot be held liable for any assumptions that these parties make as a result of them leaving a message. I am sure they are smart enought to put two and two together...but, you know what they say about assuming????

Next time, If you know you are past due, or it has been a while since you have updated your contact information...make sure you keep an open line of communication with your creditors.
