Complaint Review: drive financial services

I am filing this report, because drive financial ripp me off in high rates to fanince a 2003 chevy malibu in 2004, and repoed it in 2007, filed  judgment around or about 2009 or 2010.

     Drive also filed a judgment against me in the courts of Arlington Texas, after I had an accident in the car, and the insurance company would not fully assisit me with repair financing. However, I was disabled, and was on a fixed income at the time. They later repoed the car, and wanted me to pay for a car that I could not get possession of, caused my credit to go sour for many years. During this time there was tormenting, harrassments, and unlimted phone calls during my illnes at this time. During this time I would have paid for the car, but drive wanted me to pay for the car and they would keep possession of this vehichle.

     I hope you can help me with this terrible thing I call a nightmare, dishonest on my credit report.

I see where we're going with this.  First, you were with this SUBPRIME dealership because YOU destroyed YOUR credit prior to you buying from them.  YOU gave yourself the high interest rates because YOU made yourself a HIGH CREDIT RISK buyer because YOU gave yourself a reputation of NOT paying your bills on time.  If you don't like subprime interest rates, the only place to place blame is the image you see when you stand in front of a mirror.  You go on to say your insurance would not cover repairs after this collision.  Why not? Who chose the insurance company?  Who agreed to the coverage limits?  Again, look in the mirror.  If you were NOT carrying the required insurance as per your financing contract, then they have every right to do a repo.  When the lender does a repo, the money you owe them does not magically go away.  You are on the hook for the entire contractual amount. 

There's no ripoff here.  Either you did not carry proper insurance and/or you failed to make on time payments.  Either way, YOU turned on the collections machinery.

Don't even attempt to make the effort to hit the keys on the computer.  I'll tell you right now I don't work for them!

Go to the public records in the county where the judgment is filed and get a copy of the judgment so you have accurate information about the filing date and judgment amount. The judgment continues to accrue interest during the entire term.  You will have to look up the statutory interest allowed in your state for judgments.

As to the original payments requested for the short fall on your repossession, when you signed the contract to finance the purchase of your vehicle, you agreed to pay back the loan in full plus costs of repossession.  This is standard in all vehicle financed contracts.

The accident was unfortunate, but it does not mitigate the obligation to repay the loan. Your insurance should have covered nearly all of the amount that was due in the accident, unless you were under insured OR if you were extremely upside down in the value. It is possible that you owed much more than the vehicle was worth if you chose a high interest rate.

It is best to take care of the judgment as soon as you can because the longer you wait the more it costs because of the daily interest.

By the way, you can negotiate the payoff of a judgment with the judgment holder. Just make sure they issue you a Satisfaction of Judgment and record it in the county where you live so you have a permanent record of payment. You may want to engage the services of a consumer attorney to help you negotiate the judgment as you don't want to compound matters during your negotiations.
