My wife and I were already struggling financially when my 04 Impala died.  Because of the repair costs we were quoted and the amount of time it was going to take to get it fixed, we decided buying another car would be a more secure option for us.  My wife is pregnant and only works part time so I gave her the money to put down on a car and I went to work.  She ended up deciding to purchase from Drive Time because she found a car that she liked.  She was working with a guy named Brian there that didnt try to push her into one vehicle like other places had done but gave her different options and let her choose what she wanted.  She paid the cash down payment, signed the paperwork and came to pick me up from work in a new car.

 The first payment was due in a couple of weeks but was a few days late because money was very tight (We had just moved into a new house as well.).  The next thing I know there is a tow truck driver named Stephen showing up at my job telling me he is there to repossess the vehicle for non-payment.  Not only that but hes trying to man handle me by telling me he could have taken the car and drove off without me knowing and that he didnt have to tell me anything. 

He also stated that according to them, they never got any payment from us my wife found the receipt from when we made the payment and the story all of a sudden changed.  He then started telling me that the Drive Time policy is that if the first payment is late by even a day they will pick up the vehicle and you have to talk to them to get it back.  He even stated that they always give the vehicle back but their policy is to pick the vehicle up.  My wife started immediately trying to talk with them and got ahold of Paul who is Stephenss boss who also stated that no payment was received and then changed his story after payment confirmation was proven.  We had another session of talking with Drive Time with a lady named Tonya who informed us that because this repo was so soon, it would be like the transaction never happened they got the car and we would get our money back.  We all walk away from the table. 

This information has gotten us nowhere and we are now being told that we cant get any money back nor can we get the car.  We basically are screwed and there is nothing that they will do about it.  They basically put a loaded gun in my face and have robbed me of my money. Now we are back to square 0 My wife, whose pregnancy is high risk, was taken to the emergency room the day after the car was repossessed because of the stress and Drive Time wants me to think its ok for them to rob us of what little money we had.

You were not robbed. You defaulted on the loan agreement. You are not financially prepared to expand your family.

You are a SUBPRIME borrower otherwise you'd be dealing a bank and low APR. DT didn't do that to you...you did by developing a reputation for not paying your bills on time. You get a car from this place. They take a chance on you. You are LATE on the very first payment, you admitted that. They did a repo...because YOU chose to not pay on time! End of story! Nothing illegal, immoral or unethical here. No rip off either. Making payments when due apparently isn't part of your nature and it isn't THEIR FAULT. Want to avoid ANOTHER repo??? Its simple. Make your payments on time.
