Drivetime I would like to sue this company, my van has too many problems not covered under this limited warranty Austin Texas
I got a 2002 ford windstar from them dec of 2012, two weeks after I have it the check engine light comes on, I had to take to their approved shops to have a grommet fixed on it. They also stated that the vacuum lines had duct tape on them. Then a few months later the engine light came on again. Now being told that the intake manifold gasket need to be replaced, the warranty will not cover it, the tie rods are going out. The power steering pump is going out, that's the only thing the warranty will cover. I was told I could trade after a year , as of dec 21st it's been a year and I am being told I cannot trade in.

If the actual warranty paperwork says what is and what isn't covered and the problems you are experiencing are not covered, on what basis do you have a lawsuit?

Car salesmen use that line about trading it in to get you to accept a bad deal. In fact, hearing that line lets you know that there is a red flag with the deal. Shady salesmen use that line about trading in so you let your guard down. Next time a car salesman uses the line on you, walk away and don't accept the deal because there is a problem somewhere either with the vehicle or the financing.
The thing is, you can trade it, but not to the original dealer. The original dealer knows there is too much negative equity to accept the trade, particularly if you have a high interest rate loan. That's why Drivetime said no to your trade. You have to go to another dealership and bring enough cash with you for a large enough down payment to clear most if not all of the negative equity on the car you are trading into the other dealer. It also helps if you get your financing through a credit union prior to going to another dealer.
Drivetime doesn't have good mechanics so even if the repair were covered under their warranty, you would end up with a bad repair job. If you don't have the money to trade in your car now, get it repaired with a good local mechanic not affliated with Drivetime to keep it running until you have the ability to make the trade or sell it outright.
Don't give the car back either - then its a repo on your credit. You have to live with the consequences of the bad deal until you can sell the car or trade it. Hopefully you can get enough cash together to make that happen sooner rather than later. Good luck.
