Below are the facts:

I purchased a total of four vehicles. Three of the four vechicles have been delivered. Business (Dusty Old Cars) is still holding titles after almost a month of receiving three vehicles. I've made several attempts to call Brandon Miller (Sales Rep) for status on final delivery, but no luck, menaing just a bunch of empty promises. As of this day, no title and vehicle still pending for delivery.

I paid one hundred dollars of processing fees for each vehicle--total of $400.00. Still, Brandon Miller would prefer to send my vehicle titles with the last vehicle to save money. I will post e-mail for reference. 

I purchased these vehicles with my daughters college savings in hopes of re-selling vehicles to bump her savings, and its seems to me that they are comfortable at taking others hard-earned money for their richness. 

I usually call Customer Service and ask for Brandon. They confirm he's there, but they prefer I call another line. I call Brandon's line and someone else answers and says he is unavailable.

I paid for the three vehicles on the 29th of August, 2015. These vehicles I received (pending titles). 

I paid for the last vehicle on the 5th of September, 2015. This vehicle I have not received. 

I've saved all emails and paperwork for reference. 

If you would like to speak to me personally, I will be more than glad to have a chat with anyone interested in purchasing for this establishment.

I confirm receipt of four vehice titles, all dated 08-25-2015, along with purchase contracts.

 

Now pending is my 1960 Ford F-100 vehicle.

Update:

 

Since my last posting I have received numerous phone calls (which I did not answer due to workplace rules) and emails (which I responded in a professional manner) from the folks over at Dusty Old Cars, specifically from the owner of the establishment. Seems like the owner is now involved and interested in finding a resolution to this matter.

Before I continue writing, I should acknowledge my intentions. The purpose of these writings is to inform individuals who may have an interest in purchasing a vehicle from a seller, whoever it may be.  My intentions are not disparage others unless they have failed to meet their legal and moral obligations. Be careful what you sign.

Eduardo,

It has come to my attention that you purchased 4 vehicles from us, andhave taken delivery of 3.

It has also come to my attention that you have written a review about my company and employees onRip-off Report.  Once you write something onRip-off Report you are not able to retract it and remains on the site.

 

As of now we will be retaining your remaining vehicle and the titles to all of the vehicles as liquidated damages for posting a disparaging review about my company. I strongly encourage you to review your Motor Vehicle Purchase Contract in detailas you are precluded from making disparaging statements in public or private and we have the authority to assess fees at our sole discretion regarding your behavior.  If you are unwilling or unable to pay these fees we may report this nonpayment to the credit agencies.

You have until the close of business today to contact me regarding this matter.

Let me be clear. I am not a legal counsel. I don’t know, practice, or understand law.

As a result, I did some searching and this is what I found.

 

New Hampshire Statutes state the following:

 Title XXXIV-A

Uniform Commercial Code

Chapter 382-A

Article 2-Sales

 Part 1

 A “ sale” consists in the passing of title from the seller to the buyer for a price (Section 2-401).

 

Has the buyer paid for the vehicle? Yes. I have documentation and confirmation from the owner that payment was made, received and accepted. Read above. 

Has the seller transferred the vehicle? No. Read above.

Has the seller transferred the titles after the sale of the vehicle? No. Read above.

 

New Hampshire Department of Safety- Division of Motor Vehicles

 Buying a Vehicle from a Private Party

When a used vehicle is sold in New Hampshire, a New Hampshire title shall be signed over to the buyer at the time of the sale unless that vehicle is title exempt. For title exempt vehicles, the seller must provide a properly executed Bill of Sale along with either a current or expired New Hampshire certificate of registration or a valid NH or out-of-state certificate of Title. The buyer shall apply for a new Title in his or her name at the town/city clerk's office and register the vehicle. A $25.00 title fee will apply, along with the appropriate registration fees. A VIN verification may be required.

Are the vehicles title-exempt? No.

 382-A:2-301 General Obligations of Parties.- The obligation of  the seller is to transfer and deliver and that of the buyer is to accept and pay in accordance with the contract.

 Has the seller transferred/delivered the purchase of the vehicle? No

I am not sure what that means.

 We are filing a mechanic’s lien on the vehicle here, and we will also be filing lien’s on the titles to the other trucks.

 Additional steps will be taken as well, we will be in touch.

Honestly, I don’t know what a mechanic’s lien is, so I did some searching on the internet, and this is what I found.

 

Mechanics lien: New Hampshire Superior Court

 

If you are filing a lawsuit claiming someone owes you money, you may ask the court for an Attachment.

A Mechanics Lien is a specific type of attachment that can be placed on someone’s property. To qualify for a Mechanics Lien you must have performed work for or provided materials to that person within the last 120 days for which you have not been paid in full.

An Attachment is an official way to put a “hold” on something owned by that person so, if at the end of the case the court agrees he/she owes you money, you can sell the person’s property to receive your money.

Has the seller performed work? No.

Has the seller provided materials? No.

 

In regards to liens on the titles, New Hampshire Statutes, Chapter 450 liens on Motor Vehicles or Aircraft, this is what I found which has nothing to do with this matter.

 

Section 450:4 Lien for Nonpayment of Aircraft Registration Fees.

Dusty Old Cars- Update

I have an update from Dusty Old Cars a day after the original posting was created. 

I returned a missed phone call from CJ (Customer Service Rep.) of Dusty Old Cars. My assumption is they were informed of the posting thus, decided to call me for additional details. And so, I provided CJ with exact details of the mistreatment from Sales Rep. Brandon Miller to a customer who purchased, without hesitation, a total of four vehicles with an estimated value of 24K. 

Now, on a fundamental level, if CJ understands the important of customers, he should have communicated my concerns to the owner of the establishment. I was hoping to receive a personal call from Stephen Condodemetraky which I believe is the owner, but no luck. At this point, either he is unaware of the situation, or he is part of the shenanigans.

At any rate, I don't care. 

Open letter to CJ:

CJ, i hope you communicated my matter to your boss. You and your colleagues, your families and profession are at risk.

Why?

Derry NH has a population of about 35K. There is no way this business can survive with such a small population. I'm speculating locals purchase no more than eight vehicles per year from the establishment. With payroll, insurance, and expenses--local sales are obviously not the backbone of this establishment--you must search, work hard, and obtain business outside of Derry, right? I'm certain the internet is the company's livelihood. If not, you and your colleagues are out of a job. So why is an indivdual like Brandon Miller biting the very hands that feed you and everyone else employed in that establishment? Is everyone participating in shenanigans, or is everyone just plain stupid? I hope you read this and talk about it in detail--if you plan to have a future with the company. 

Now, let me change topic and communicate to all of you about a recent embarresment I experienced.

As mentioned before, I purchased these vehicles from my daughter's savings in hopes of bumping her money for college (Yes, you are stealing from a 15 year-old girl). I work hard and save just like the rest of ordinary individuals. 

Prior to purchasing the vehicles I did some research over the internet, and found arguments for and against this establishment. Still, I took the risk of transferring 24K for the purchase of four vehicles. I received three of the four vehicles, but without titles. As you may know, I live in an apartment complex. People from the vecinity have approached me and expressed interest in the vehicles. They have enjoyed seeing these trucks parked outside the complex. I mentioned trucks were for sale, but wasn't able to provide details due to pending titles--first embarresment. How does someone purchase a vehicle without a title? A week passes and the same people approach me for an update, but no luck. No title, no sale. After explaining the situation, they've lost interest. it's been several weeks now and the same people pass along without interest. I've lost the potential of selling my vehicles to the closest individuals living near the area which translates to no more purchasing vehicles from you--which means loss of revenue for the establishment. I lost potentional customers because Brandon Miller's logic was to send important documents with the vehicle he still holds from me. I countered with an alternative to Brandon--send my title docuements via courier! What a brillant idea, right? After all, they're just titles to my vehicles. Not to mention, I paid one hundred dollars in processing fees for each vehicle--a total of four hundred dollars. Brandon's response was, " I can do that, I just figured it would save a few dollars to put it in the truck.  I will mail them to you instead." I have the email for reference, and four days later, the courier with my titles has not arrived.

Are you understanding my frustration now? Do you understand why I'm posting all this factual information? I hope you all understand my frustration. I am sitting with three vehicles, unable to sell them, thanks to Brandon. What could of been a returning customer, which translates to revenue,is now over and done with--never again! And I intend to protect potential customers from falling in the same trap, which means less revenue for your establishment. 

Ironically, I received a phone call from Brandon later in the afternoon. After all I've been through, this guy has the audacity to tell me that he will only ship my truck if I remove this posting--what a freakin' idiot! 

Open message to Brandon Miller

Brandon, You have until the 30th of October to . . .

a). deliver my truck--free of charge. And it must be received as pictured. Yes, I have most pictures of the vehicle. If damaged, i will refuse and continue my quest of informing potential customers of your shenanigans. And you can shove my daughter's money up your you know where. If I'm gonna lose my daughter's money, I'm d**n sure gonna bring this establishment down with me as well. 

and

b). mail all my original titles and any other important documents.

Dusty Old Cars- Pending Vehicle

After reading the negative history of this establishment, I have a feeling my vehicle has been sold to a higher bidder thus,  adding a picture of the vehicle I purchased and paid for over a month ago, but has not been delivered.
