I purchased a stove from New Mexico Fireplace Gallery located at 11105 Menaul in Albuquerque, NM 87112. It was a pellet stove(NM Fireplace Gallery) and the manufacturer, but to no avail and was told I was just a "dumb" blonde who couldn't work the mechanics of the stove.

Subsequently, I drove to the store demanding a refund. Indead, the owner called the cops and tried to have me arrested. I then filed a suit against hime in the Bernalillo court system. I attended 3 hearing and the 4th I missed due to the fact that no notice was sent, so case dropped.

Now, I am out over 2,000. and have no stove. In addition, Duvera was notified of the mal-functioning stove as well as the return and ordered to Cease and Desiste trying to obtain payment. Instead they issued a report on my credit which has hurt my credit score terribly. They are both frauds...watch out for both.

I returned the stove the NM Fireplace at my own cost. They tried to charge me an additional $125. to pick up the stove and return it. I made 3 trips to the store location on Menaul to alert the owner of the faulty design as well as absurd amount of time that the electric igniter took to ignite the small amount of pellets in the chamber. The stove didn't even warm a 500 sq. ft. room!

When I returned the stove to the owner of the NM Fireplace Gallery on Menaul, he tried to prevent me from bringing the stove into his store , as well as called police to come and arrest me for returning a faulty product! I filed a suit against the company, NM Fireplace Gallery, and made three trips to the ABQ. court until the final hearing. I didn't receive any notice, so my case was dismissed.

My brother-in-law is an attorney in Indiana and he tried to help me by writing to both DuVera and NM FirePlace Gallery. The owner reponded by filing a complaint with the NM Law Board that my brother-in-law was practicing law out of state!! Pete also wrote to DuVera about their "fradulant" charges and a cease and desist was issued. They no longer call me, but filed two complaints against my credit for non payment, even though the stove was returned. Now I am out what I paid for the stove in cash and payments, approximately $1,600., but my credit has been further damaged. 

Please, don't do business with NM Firepalce Gallery or ever sign a contact with DuVera or EasyPay or whatever name they are working under. Both are dishonest business practices.

Maybe now I will file another suit against the to finalize the contract. How much time do I have??? Each filing cost either $25 to $50. and many trips to ALbuquerque, which for me is a 50 mile round trip.

...You were supposed to make payments and you failed to do so. The finance contract is separate from the alleged problems you had with the product. Until and unless the contract is ruled null and void by a judge, the contract is still in force. Any late payments or lack of payments are a part of your credit record.
