EASTON ENTERPRISES INC. sells faulty FANTASY GLOW glow sticks
I met George Fang (I suspect, not his real name) exhibiting for EASTON ENTERPRISES INC.,Anaheim, CA, at a trade show selling FANTASY GLOW glow sticks. Months later I was interested in purchasing 7000 glow sticks for a customer's promotions. I live and work in Guatemala. I emailed George. He indicated he had a closeout for a reduced price for sales out of the US. Immediately I doubted quality, I figured they wouldn't light. He assured me that they worked and were on closeout because of the design. I understood them to be an exact copy of CYALUME'S glow stick and CYALUME probably sued them.
I purchased 7000 units and when they arrived, before taking them to my customer, I opened one to try it out. I realized it was faulty and opened another 50 or so. My results ranged from not lighting at all to lighting fully. About 10-15% worked fine. about 30% did not light at all. The rest were somewhere in the middle. Since it is impossible to tell which are the good ones without activating them, I couldn't honestly sell them to my customer.
When I confronted George Fang, he said that it was c closeout and there were no guarantees. I indicated that he had assuered me that the quality was good and then I never heard back from him. I told him I would sue him and he did not care.
Since I am in another country, he figured I wouldn't do anything. I went up to CA last month for another trade show. While there I went to the courthouse to start the suit. I found out that the address for his business is just a PO Box and that couldn't be used for the suit. I tried the reverse directory and his numbers I guess are unlisted, because I couldn't get an address. So, all I have for him are a phone #, a fax #, a PO Box, another address that I didn't have time to check out and his email address. Also I wrote to the State of California and got a 'statemant by foreign corporation'.
Since I don't live in that area, it is hard to track him down.

We did sell this Guatemala customer some glow sticks back in 2001.
As he stated in his letter, that He was fully aware of that these were closed out (due to the package changing)and sold as is. We sent him samples to confirm the packages and quality. Since these were individul foil pack lightsticks, so there is no way for us to just sent him the good ones (no cherry pick, we sent him the random samples), and he was pleased with the samples. Few weeks later, he sent payment, we shipped complete order to his shipping agent in Miami.
Few months later, he called and emailed us with the quality problem. We notified him the items were close out and sold as is, it was few months after the sale, so we would not take back or credit him for the products. And finally he told us that his shipping agent in Miami held his orders outside the warehouse (shipping yard)for a while (waiting for consolidating with other merchandises to the same container), and these sticks were exposed direct in hot sunlight. We told him that this was not good for the glow sticks, it might caused the problems.
We have been in business since 1995, and we only carry the premium quality products. We have supplied many major national chain stores the Fantasy Glow products: Albertson Supermarket, 7-11 stores, Sav-On Drugs, just name few, if we carry the low quality products, we would be in the business for these years.
There is another way you can check our repetation by checking the seller name in Ebay under "Fantasyglow" you will see the highest rating (100% positive feedback) from hundreds buyers in years.
