Ebay, PayPal, DEM Computersonline's Greg DeMilio took my money and NEVER sent me a computer. Rip-off! Frankfort Illinois

On Jan 14 2004 I won an Ebay auction for a computer from Greg DeMilio at DEM Computersonline. I paid immediately through PayPal, Mr. DeMilio acknowledged receipt of my payment on Jan 15th 2004, I waited 7 days, no computer was shipped to me, I emailed Greg DeMilio many times and he made many excuses, I then discovered that his company had been suspended from trading on Ebay.

On Feb 4th I began an investigation with PayPal, PayPal waited until Feb 22nd to Tell me there was nothing they could do, that Mr. Demilio had been paid and that I was out of luck.

On Mon the 23rd I emailed Mr. Demilio that I was preparing to pursue criminal fraud charges at that time. He emailed back saying he would ship my computer no later then Wed the 25th.

Since Mr. DeMilio had made many promises to me in the past that he did not keep, I also contacted my Credit Card company and started a chargeback with them against PayPal. My CC company informed that is was very unlikely that I would receive anything back from PayPal, That PayPal was not the vendor in the transaction and I would have no recourse against them.

On Feb 25th Mr. DeMilio emailed me saying that PayPal had charged back his account and that he would therefor not send me the computer. As of this writing I have been charged $500.00 that was paid to Mr. DeMilio I dont have my money or the computer

I'm still left wondering what was the reasoning for your being suspended from ebay if not because of the incident between you and Mr. Clark? You were very quick to deny this, but failed to give any info about it in your rebuttal.

THIS IS GETTING OLD..........Yes it is correct that this person won auction, my being suspended has nothing to do with any of this. I will give you the short version of what happened.. Customer won auction, auction was paid for, customer didn't like how long shipping was taking so they reversed it with PayPal, PayPal couldn't give customer money back because Ebay and PayPal had a lock on my account. After Mr. Clark emailed me and said that he didn't get money back he then agreed to have computer over nighted to him, on the morning it was going out I got notice from PayPal that I owe them for the payment that was made by Mr. Clark because he CHARGED IT BACK WITH HIS CREDIT CARD COMPANY! Now he claims it is fraud that I will not ship his item. Only a fool would ship an item out at this point, what is so hard to understand that when you do a charge back you no longer have paid.

My problem at this point is between me and PayPal because they want the money from me that Mr. Clark took back from PayPal....
