Regarding an eBay purchase paid for on June 16, 2008. EBAY Item #290237568913 Advertised as 1998 King of the Road Crown Marquis C35CK 5th Wheel RV Trailer. Initial amount involved USD $13,200.00 Those involved: eBay Customer Service - eBay Trust & Safety - EBay Vehicle Buyer Protection - The Selling Team: SALVAGE TRAILER, Doing Business As Fun Finder Sales LLC - John Pierce Oshaugnhessy. Valerie J. McDowell. Kimberly L. Hoke (employee acting as Notary Public). eBay Customer Service Phone Number1-888-445-4992 Address where the Selling Team operates: 2990 S. This would include delivery of the trailer to Portal, North Dakota. Breakdown of cost was USD $12,500.00 for trailer and USD $700.00 for delivery of the trailer to Portal, ND. John Pierce Oshaugnhessy received the Down Payment of USD $500.00 on June 16, 2008 via PayPal. This trailer was advertised: "As Is - Where Is" - Insurance Auction And also: * "This ones ready for full time park living or travelling in style". UNTRUE - Once I got this trailer to my home and extended the Slide Outs and realized the floor and walls in the Living Room and Bedroom were severely rotten and I could not even retract the Living Room Slide Out due to this. * This trailer had interior smoke damage from a refrigerator fire, wiring and cabinet have repaired/replaced. It has been tested and all systems are operating properly". UNTRUE - The electrical wiring was a mess in a camouflaged severely burnt and charred area behind the fridge. This was no longer a cabinet, it was a boxed in and burnt, camouflaged mess of electrical wires. This was not disclosed with all their pictures that do not give a true picture anyway. Thirty foot pictures can look good. * "These units are perfect for the average handyman that can repair the minor damage and save themselves $$$$". UNTRUE - This trailer has major structural damage on the three slide outs. They do not slose up or seal properly. The Bedroom Slide Out leaked water profusely during a rain storm and as well as complex electrical systems malfunctioning. These major problems require a specialized repair shop. *Overview/Features: "Overall Condition of this trailer - GOOD". UNTRUE - * "14' Living Room Slide" UNTRUE - 8' only * "16' Super Slide" UNTRUE - 14' only * "Basement storage w/slide out trays". UNTRUE - No slide out trays I bought this trailer through eBay that advertises right on the front page of this trailer's presentation about USD $50,000.00 Buyer Protection. There is no easily understood thought or direction otherwise. This is supposed to give a Buyer comfort with the thought that eBay will protect. This trailer deal was processed on June 16, 2008. On Jul 29, 2008 the Seller delivered this trailer. The Seller delivered this trailer and not to Portal, ND a 24 hour USA/Canada Border Crossing as agreed upon. He made me go to Kenmare, ND. 45 miles south of the USA/Canada Customs Border Crossing. A 24 hour Border Crossing and a 24 hour Fueling Station (Gastrac) and with access to the Americana Motel in Portal, ND that did have rooms available. I know, because I had phoned and confirmed this with the hotel. July 31, 2008 I initiated the eBay Complaint - "Item Received But Significantly Not As Described". This communication with the Seller escalated into No Resolution. August 11, 2008 eBay Trust & Safety received my complaint about this. August 14, 2008 eBay Vehicle Purchase Protection received my Reimbursement Request. which they denied. The stated, "I must claim for this within 30 days of the sale date of June 16, 2008. This is news to me, as I said there was no indication of this right up-front. And eBay's convoluted web site is not for a novice computer person. It is plain to see that I expeditiously followed through with all complaints once I had received the trailer. When I was denied any reasonable help, I went ahead as well as possible to fix this trailer so it could at least be moved and closed up for inclement weather. Winter here is severe. To date I have spent in excess of $8,500.00 to remedy the rotten floor and wall problem. There is still the slide out seals and complex electrical problem to be corrected that will take an amount that is unable to be estimated. October 21, 2008 I initiated another request to eBay to Reconsider my Request For Buyer Protection. I had indicated I was seeking Fair, Upright and Honorable Justice. October 22, 2008 I received an email from eBay Customer Support stating: "Thank you for writing eBay in regard to the trailer you purchased that was not as described". "Unfortunately, this purchase is not elegible for reimbursement under the eBay Vehicle Purchase Protection Program. Also, because this listing ended more than 60 days ago, it's no longer possible to open an Item Not Received or Significantly Not As Describes dispute. (Disputes must be filed between 10 and 60 days after the listing ends.)" "But please be assured that we take your complaint very seriously. We'll investigate this seller and take appropriate action." ***I FIND THIS UNTRUE AND UNHELPFUL*** * Free Enterprise At Work??? * No Conscience??? * No Sense of Ethics??? * No Sense of Right and Wrong??? * No Honorable Justice??? To show the mentality of the Seller who does business as Fun Finder Sales LLC. They advertise also on the web and show this unit right up front with their approach! Can I be helped in this sad but true story? I find no fun in any of this.

John Pierce Oshaughessy claims he was a farmer from Unity, Saskatchewan. Operating business with cohort Valerie J. McDowell. It takes time, but what goes around comes around. The last I heard of them, they changed therir trade name and they were selling wrist watches on EBay. They learned their business practice in Mexico and then set up in South Carolina. 

 

Have they prospered or reaped what they sow?

Fraud is Deception Deliberately Practised In Order To Secure Unfair or Unlawful Gain.
South Carolina Statue of Limitations for Fraud is Three Years.

These people advertised over eBay about Overview/Features:
"Overall Condition of this trailer -GOOD"

They also indicate on their Fun Finder Sales web site that they are quite knowledgable about trailers.
This also points to the fact that they were practising an Unfair, Deceptive and Misrepresented Trade Practise.

A question to think about:
Why would these guys be so anxious to haul this trailer 1750 miles from South Carolina to the USA/Canada Border and do a quick turnover in a parking lot and only charge $700.00 for transporting the trailer?

EBAY can not be trusted when a Big Ticket Item is involved. The average person can not be aware of all the legalities involved on their convoluted web site an right up front EBAY advertises $50,000.00 Buyer Protection.

A Lesson From This Issue Might Be:
1) Do Not Buy From an eBay Seller That Is Not Bonded or Insured.
2) Do Not Deal or Buy From Crooks and Liars
3) On a Big Ticket Item Do Not Trust The EBAY $50,000.00 Buyer Protection Advertising without legal guidance.

Any Ethical and Trustworthy Seller Is Not Ambiguous. Selling the idea that "This ones ready for full time park living or travelling in style" OR "These units are perfect for the average handyman that can repair minor damage and save themselves $$$$".
When this unit was not ready for full time living or travelling in style OR perfect for the average handyman that can repair minor damage.
AND Then say As Is Where Is. That is what is called Split Tongued.
This trailer was "Significantly Not As Described".

You can not legally have it two ways.

This eBay deal was made for delivery to Portal, North Dakota. That is where return of this trailer would be delivered after complete reimbursement of the money paid out and repair expenses were covered.

If this Seller was telling the truth, eBay would not have removed his FeedBack Comment that I owed him money. eBay Documentation proves that.

Also, if this Seller was telling the truth, this Rip-Off Report would be adjusted accordingly. However, the Rip-Off Report stands with this Seller shown up to be grossly in the wrong.

If this guy said, "Good Morning", it would be highly recommended to take a look outside!

Pierce and Val - You should be ashamed of yourselves.
I do not know which of you is most reprehensible.

eBay is guilty by association and contributing to a Seller profiting from unethical selling and possibly fraud in the legal sense.

I was told about this complaint by another of my customers who saw it here. I have read with amusement this complaint and the many points of fantasy recited by this person.

Let me in short form give our side of the story and let the comsumers decide the facts.

Our company sells insurance salvage trailers and campers with the advantage to the buyer of cheaper purchase prices because of the work required to bring them back to perfect condition. This trailer had had a interior fire and had been partialy repaired and like all of our trailers,was listed as such.

It was sold with the buy it now feature on Ebay and we were contacted by the buyer who paid his deposit and enquired as to how much we would charge to deliver the trailer to the canadian border near ND. We told him we charge $2.25 per mile and could deliver in 3 weeks. This was agreed upon over and above the price of sale and the buyer agreed to pay the $2550.00 usd delivery fee upon receiving the trailer.Delivery and a two hour inspection happened but the customer only had $800.00 usd of the delivery fee with him as he said that was all he could get out of the local ATM machine. We agreed to release the trailer to him provided he sent the balance of funds to us buy overnight letter when he was back in Canada.

That was our first mistake. While we did not get paid for the balance of the delivery
charge.The buyer demanded $2500.00 usd from us becase the trailer needed morework than he had envisioned. To make matters worse,he threatened to leave bad feedback if we did not pay this amount.

This trailer was sold AS IS WHERE IS and disclosure was made as to its salvage condition. His inability to repair the trailer was not part of the contract but the buyer seemed to think this was negotiable after the sale and the exportation of the trailer.
I offered him a complete refund through Ebay if he returned the trailer to our yard.

He did not want to return the trailer to us and wanted the money from us.We have not received the outstanding funds for delivery from buyer nor has Ebay contacted us about the transaction. It was our fault to trust this buyer with delivery fees and because of this purchaser we no longer sell to Canada.

This buyer not only tried to blackmail us into paying him but did indeed leave us unwarranted bad feedback with Ebay.

It is my opinion that this was an attempt to extort additional funds beyond the money he already owed us to help with the repairs the trailer needed.

Ebay takes these claims in a serious light and does investigate them. I am still selling onEbay and have never had an experience such as the one I had with this person and it has made us demand payments in full from all customers now as trust is something that is is the past for us.

Thank you for the chance to put our side up so people can see both sides.
