Complaint Review: EFT GROUP/ RETRO FITNESS

EFT GROUP/ RETRO FITNESS Personal Trainer lied about my contract agreement. didnt show up to 3 of our sessions and didnt return my calls in 11 days. Lied about canceling my contract and now my case is in collections Raleigh, North Carolina

To whom it may concern,

Im writing to you, regarding an issue I had with Personal Trainer Manager Armando at Retro Fitness 6402 Kennedy Blvd W, West New York, Nj, 07093.

A verbal agreement was made between the manager personal Trainer, Armando, and I, that I would not only be able to cancel my contract at any time but that I would also get 2 personal training sessions a month for which I paid a down payment of $189.He also promised to measure me and follow my progress as well as creating a diet for me. I've kept a copy of the diet he wrote for me on the back of a piece of paperwhich I found rather unprofessional.

At that time I was about to enter a full time dancing program so I wanted to make sure I could cancel my contract at anytime with no fees. Armando assured me that all I had to do was to send a certified letter to corporate 3 days prior my next payment and it would be canceled.

My 2 first sessions went well then Armando stop showing up for our appointments.On 3 differents occasions,He stood me up and he didn't bother letting me know in advance or to find a replacement. Armando then took 11 days to return my calls and eventually responded via text messages,which I can provide upon request.

At this point Armando had breached the contract by not showing up to our appointments and charged me for sessions I did not received. I sent a certified mail to your EFT Group to let them know that I was requesting to terminate my contract, like Armando suggest to do. EFT then contacted me to tell me that the person in charge of my case I believe Nathalie was gone on vacation and that I needed to send the proof that I had mailed them a certified letter. which I did again.

EFT then contacted me to let me know that they can't cancel my contract unless I pay 75% of the contract plus 250 dollars of cancelation fees. I was very upset and contacted Armando. He assured me that he would talk to corporate and cancel the contract. He then messaged me to tell me that my contract was canceled. I have his messages to back it up.

Few months later I was contacted by the collection agency, telling me that my case was in collections and my contract was never canceled. EFT Group and the collector wants me to pay about 2000 dollars,Otherwise they will have the right to put a levy on my account and destroy my credits. Armando has been unprofessional and inconsiderate of my time.

I'm requesting the immediate cancellation of my contract plus a refund of my down payment as well as the 4 sessions that I paid for and did not receive for a grand total of $329.
