My story with Elvis Towing was they towed my car which was understandable because it was in a tow zone. When i went to recover my car from their impound lot I called the office and the owner went in to a verbal tiraid about how i cant get outta my car or they will call the police and accused me of being a potential burgular when I called him with cash in hand to pick up my car! When I retieved my car my linkage in my car was broken resulting the car not fully going into park there for rolling down a hill when in park. Not to mention it wouldnt start unless it was in nuetral. I go to my local wrench turner and he tells me i should contact the office because thats a common problem happening when a car is towed. I called left a message for owner Morrison Johnson which returned my call.I checked my voicemail and called him on monday. Morrison was immidiatly stand offish and defensive. I was only asking him what he suggest i do. Mr.Johnson became very irate and hung up on me. Promply he called back my place of business threating my boss & I that he would sue us if we contact him or my own attorney. All I wanted was help. I experianced a level of unprofessionalism the was unprecidented

#3REBUTTAL Owner of company

Wed, April 07, 2010

1st) Most Important, the gentleman that retrieved the vehicle described in this complaint from impoundment, was shown as the registered owner, with proper ID, paying the bill, signed for the vehicle, starting & driving the vehicle off our property with No issues at all, Isn't the gentleman that has filed this complaint !!!!!!! We received 4 calls from a person between 8:30-11:00 pm on Sunday evening, each time advise that they would be required to have proper ID, exact funds in cash & call 30 minutes prior to wanting to retrieve their vehicle being that it wasn't during regular business hours & a driver & a police officer if needed would have to be dispatched for the release. Note: State Law allows 1 hours previous notice for releases. A customer called at 11:00 pm with No appointment made, to retrieve the vehicle stating he was located on our property & wanting to pick up the vehicle, He was advised Not to get out of his vehicle as there is a blanket trespass for our property with local law enforcement for anyone caught on site after regular business hours, to save him any problems, that he was suppose to park in a specific spot under the lighted canopy for his safety & that law enforcement would know he was suppose to be there & would Not be arrested for the trespassing as he didn't follow the directions given 3 time previously. He was told that a driver & law enforcement would be dispatched immediately & be on site within 30 minutes. The gentleman said he was going to leave the property so as not to have any issues & was going to get something to eat & would return at 11:30 pm. A driver was on site at 11:25 & released the vehicle with know problems to a gentleman that wasn't Darrell Hollins & had all required items needed. It wasn't until 6 days later on Friday 2/12/10 at 5:25 did we receive a call from a gentleman claiming to Darrell Hollins about the 89 lincoln towncar claiming to have an issue. A call was immediately returned to the business that the gentleman claiming to be Darrell Hollins works for, he wasn't available & we were given his cell number & a call was made immediately to the cell & a message was left stating company policy, in that there was know complaints noted at time of the vehicle release & had there been, that local law enforcement would have been called to document any issues for his & our protection, also failing to make us aware immediately that evening of his claim in the driveway just after the car was driven off our property. It wasn't until 3 days later on Monday 2/15/10 at 5:30 pm a total of 9 day after the release did a gentleman claiming to be Darrell Hollins contact us. Advising that a wrench turner claimed the E-brake in the transmission was broken, the e-brake is located in the rearend of the car not the transmission. I tried to explain to him that had the vehicle had a transmission issue, being that the vehicle was brought in on a transport, when the bed was tilted to load or unload the vehicle it would have rolled, this wasn't the case. I asked for documentation & was told there was none??. I advised that we would not be doing anything in regards to his claim as it wasn't done according to company policy to protect all parties involved & that we would agree to disagree on his issue. At that point he verbally threatened that he was going to do anything he could to file complaints against our company anywhere he could & that he had tape recorded our complete conversation without my knowledge or approval, at that point I told him I was disconnecting the conversation & calling legal council for advisement & did so. Our attorney advise to contact the supervisor of the company to make them aware in all fairness of what had taken place on their time, equipment & also possibly the illegal taping of the conversation that had taken place. I called the company & asked for the supervisor, a gentleman got on the phone & stated he was Darrell Hollins supervisor & asked what this pertained to, I started to advise what had taken place & he interrupted me stating we had damaged the car & we needed to fix it etc., I tried to tell him I was only making him aware of what had taken place by one of his employee's & that I could see it was falling on deaf ears & I would be disconnecting the call & deal with it in another forum. 2) The Better Business Bureau closed their complaint - wasn't the customer that picked up vehicle. 3) State of Florida, The Division of Consumer Service closed their complaint - "CS" closed satisfactorily with my response. 4) Department of Justice & Consumer Services closed their complaint - Information Only. We have been in business since 1976 same location with only 2 complaints, both No Basis found in either situation. Once again, the gentleman claiming to be Darrell Hollins that filed this, Wasn't even the gentleman that showed proper ID, proof of ownership, paid the bill, signed for it & drove the vehicle off the property with No issues hasn't ever contacted us.

TWO THINGS

#3General Comment

Two things: 1st a threat is illegal and you should report this to the police even if you don't have a witness, if he threatened your boss or another employee the police should be able to take action. This type of behavior is un-.  2nd towing a vehicle is at the owners risk and expense, to get "help" with the repair costs you would have to show the driver was actively negligent or abusive to your vehicle. I think this is likely considering symptoms. But.... No towing company pays any damage claim unless forced, there are so many scamers out there that they would be out of business over night. Good Luck
