I took out a Home Equity loan with one company who in turn sold it to another within months, then this second company (Company B) sold it to EMC Mortgage Corporation without notifying us of the transaction. ALL of this was done within a few months. My payments are due on the 1st day of each month.

I received a statement from Company A and sent the payment in to reach them by June 1, 2005. The check cleared the bank. In a letter dated June 6, 2005 from EMC Mortgage, we were notified that they had bought my loan.

Then I start getting phone calls stating I did not make my June 1 payment. I faxed (and mailed) them copies of my bank statement showing the money had been taken out of my account, along with the fron and back of checks. I even included copies of front and back of the July 1 payment (they were saying I had not made those payments).

Finally got a fella by the name of Chris who stated not to worry they would straighten it out and I would not receive any more phone calls--THAT WAS FIVE (5) MONTHS AGO! I continue to receive harrassing phone calls and every statement states I am behind two payments, even though I have the proof every payment was made and cleared my bank. Then, we didn't receive a state for Jan. 1 payment, so I called and they said just put it in the mail (this was my first late payment in the entire 5 years I have had a Home Equity Loan). I put the payment in the mail with the account number on the bottom of the check.

Well yesterday I received two calls from EMC Mortgage saying I was two payments behind. Today I received a phone call saying I had not mailed the January payment and still owed for December 2005. I informed her the Dec. payment had already cleared the bank and that they should hire some competent folks to do their accounting. The woman informed me she was making a note of what I had told her. Don't know why, when she had stated she was recording the conversation.

These folks (EMC Corporation) has 71 complaints against them with the Attorney General's office in Texas as of my conversation with that state office today at around 1p.m. EMC MORTGAGE CORPORATION IS A RIP-OFF IF EVER THERE WAS ONE AND SOMEONE. HELLO OUT THERE. NEEDS TO TAKE THEM OUT OF BUSINESS.

I too, was a victim of EMC Mortgage (Please see my posting from June 2006, Baltimore, MD). I did research such as yourself & I found that they had hooked many people. I also made phone calls to them & I was reassured that I was WRONG by some, MAYBE right hy a few and I actually had one person that agreed with me. Did this get my money back --- NO!!!

What we need is as many as possible to file a class action suit, if for anything, aggravation. If it is postable here, please give some info as to who to call. The more that file, the more chance we have of closing them down!!! I have already re-fi'ed, but I would like to get some of what I lost back.

This is a common con game. They want your house.
I have seen this all too often in my past in the MTG business.

Federal Law requires any lender who sells your loan to notify you at least 30 days prior to your next due date. Any change of payee requires at least 30 days written notice.

Here's what you do. Send a cerified letter, return reciept requested, to your original lender requesting written verification of the effective date of sale and to whom. Be sure to put the certified# on the letter itself, and keep a copy for your records.

Then send a letter to the 2nd MTG CO and request from them the effective date they took possession of the loan, and also the effecive date of sale to EMC.

Then send another letter to EMC requesting verification of the effective date they took possession of your loan.

Stay off the phone! DO NOT speak with ANYONE on the phone for ANY reason. Phone calls do not protect your rights. Do everything in writing and send by the means above.

FYI...You are not obligated to send anyone a payment without the 30 day prior notification of change of Payee. You keep paying the old co until you get it.

This is how they get you. Beware!!

Jeffrey's Question, Did I Lose My Home

Haven't lost it yet Jeffrey, but my advice is to stay on top of things, keep good records. I keep a copy of everything in my safe deposit box and a copy goes to two different law firms. I send all payments Certified, Return Receipt Requested and copies of that go to each law firm. I understand that otherwise payments are left in a lock box and not picked up for 14 or so days (a former employee told me this).

I also filed information with a Law Firm that I understand has, or is perhaps filing a Class Action Lawsuit. They were very helpful to direct me to the right agencies and the things I should do to get control of my loan. You may be interested to know that ONE OF THE GOVERNMENT AGENCIES that I was referred to and contacted on several occasions NEVER returned one phone call, NOT EVEN ONE, and I made more than one call, even told them it was urgent....now that raised a red flag! Why is the government not helping the consumer? Are they looking out for EMC? Sorry you had to go thru all you've been thru, but if I can be of help, please don't hesitate to contact me. Millie

Sorry to say millie you are in game of crooks. I had problems. Last year tried to reifinance, fell for a predatory lender on other line. He said sure doesnt sound like a problem. I will call you back tommorow let you know if you qualify for a refinance. The guy said I need to put you on a conference call with my partner. He said can you explain where your mortgage payments have been going? I was like what do you mean? He then said well the credit bureau says you havent made any payments for 10months. How bout we buy your house laughing and rent it back to you! sorry no refi. I was shocked. Constant torment and terror yep they are emc. File complaints and get legal help or sell. Please let me know what outcome is. Emc wants you to feel like a hopeless victim. It's really sad. Don't sign forebearance,
