Our Origional mortgage was with Superior Bank. Next thing I know-LaSalle banks has it- but I recieve no billing info. We keep sending payments to Superior- as we know nothing else to do. Next thing we know- EMC is servicing the loan & start out by starting foreclosure procedings. Several payments lost now- have no choice but go into their forebearance program. Give them big money up front- make ballooned payments, while they try to find the lost money. They never did. (Hmmmmm) We made our payments as they required by the due date- but each month we get late notices.

6 months later- out of the blue- they start foreclosure AGAIN. They start to refuse our payments & we are forced once again to make another forebearance agreement. This time we understand that there is nearly $2,000 in legal fee's added on. We have no choice- as our crewdit was ruined. Give them big money up front again- & now are making double payments.

Insurance becomes an issue. They force us to purchase THEIR insurance- yet no policy is given to us. Then next thing we know- Our taxes are being paid by them- a year in advance- so that they can charge us 13.67% interest on that as well. Still late notices are being sent each & every month, in spite of payments being western Unioned to them 2 weeks in advance. They started adding on "inspection fee's" Nobody ever came & inspected out home.

Out of the blue- once again- in spite of payments being made prior to the due date- last March- they filed foreclosure proceding once again- with the legal fee's & inspection fee's all over again. We tried to refinance with other companies. Not a chance. EMC reported that we were late every month. Nobody would touch us. So once again- we agree to their forebearance agreement. $6,000 in advance & more than double payments each month.

In the last 3 years we have paid them more than $45,000--- for a $60,000 mortgage. The worst part is that our owed amount is now more than 10,000 more than than the origional loan.

This summer- I got fed up & started calling them every month complaining about getting late notices- when I had proof that the payment was western unioned to them long before the due date. Each & every time they had a different story & assured me that the payment has been made & that all is fine. Until last month- when we read in the paper that they have started foreclosure procedings against us again- & that the sale date is less than 1 month away. NO notice from them- whatsoever. It's obvious to me that they now have given up on making me broke & just want the house & plan to steal it out from under me.

I have tried once again to get refinancing. Only to be informed that this is impossible- as they have my credit listed as being in foreclosure procedings 6 times in the last 2 years. WRONG. 2 times & both were unfair. They have each payment as being 1 month late. Wrong again.

They have tried to ruin us. Our car insurance has been cancelled by our insurance company for a bad credit rating & I have been turned down 5 times by different companies. Now the state is going to suspend our plates- as we have no proof of insurance. I have tried lawyers-- but nothing has come out of it. Oh & Health insurance?? Forget it! & I have an epileptic daughter!!!

Has ANYBODY been able to settle a forebearance agreement with this company??

I COMPOSED A COMPLAINT AGAINST EMC MYSELF AND I RECEIVED A REBUTTAL, TELLING ME TO CALL THIS BEAR STEARNS AND WHILE ON THE PHONE WITH ME HE ALSO GOT EMC ON THE PHONE AS WELL. EXPLAINED THE SITUATION AND SAID HE WILL TAKE CARE OF IT. WELL IN ABOUT 30 MINUTES EMC WAS CALLING ME TO STRAIGHTEN IT OUT. I DIDNT GET EVERYTHING STRAIGHT BUT IT BOUGHT ME MORE TIME. SO GIVE THEM A CALL. A NICE LADY FROM MICHIGAN TOLD ME ABOUT THEM HELPING HER. SO CALL THEM IT CANT HURT.

I have spent the last few days researching EMC -
They have a HUGE history of being a preditor. A forclosure mill of sorts. The description/problems I used is being said by thousands of homeowners now & thousands more former home owners. They prey on the weak- reducing them to creditlessness & homelessness. But only after they have forced them into forebearance agreements, taking all their money.

They are guilty of preditory lending, preditory servicing, accounting fraud, credit data manipulation & cival conspiracy.

This is white collar crime. American terrorists who prey on Americans. By looking at political donations of companies like these- there won't be any changes- as they have congress locked up & in their pockets.

If this was happening in ANY other business--- they would be in jail. But they have taken OUR millions & bought their protection with getting prefferencial treatment with the courts.

Fraud, racketteering, there are many names for it. It's an epidemic. It's Mortgage Servicing Terrorism. Try to get out of it if you can. Most likely you won't.
