We were starting to sell huge amounts of N95's on EBAY. He assured us that he could handle the orders that were coming in. All payments that were paid to him were via PayPal.
The first order we placed, a total of 12 orders from EBAY, went pretty smooth. Some shipping problems and minor delays, but nonetheless, smooth.
Then we started getting a lot of business. In 2 months, we had ordered over 50 phones. All paid to us, then we paid him via PayPal. A couple of phones made it out. We received tracking numbers for the first 12 phones, and a couple of the others. Then the problems became out of control. Delay after delay....nothing was sent out. Then the excuses came. Telling us that he would take care of it and to give him some time. Erick told us from the beginning that he was direct with a distributor. This is false information. He was sourcing out the product to fill our orders. 1-3 phones at a time.
Our customers were getting pretty upset, as we couldn't give them a timeline as to when there product was going to be delivered. Of course, after a while, we start having problems of our own. Soon enough, our PayPal account was limited. Our EBAY account was limited. And the claims started coming into PayPal. We used our own funds to start repaying our customers.
However, we fell short of funds and still owe our customers to this day.
Erick claimed he was going to travel to NY to talk to his supplier about the funds he needed to pay back to us. We haven't heard from him since. He has stopped taking our phone calls, won't return our messages nor emails. We filed over 40 disputes through PayPal, to try and retreive our money, however there was no funds in his account to retrieve for us. We won our case on all disputes we filed.
Erick also sells shoes. He made a comment regarding the problems he was facing with us and said " this doesn't compare to the problems I have with customers from the summer months". He claims that the product he was supposed to have delivered to those customers were never delivered, and that he needed to come up with money for those individuals as well. This is why, there was no money in his PayPal account. All the funds he had in there were already allocated to the other customers.
I have reports to show all the funds that we sent to him. I have reports of the claims, disputes and the refunds we had to issue.
