I canceled my profile on a dating web site several months ago, but just recently discovered that the company has been continuing to deduct from my bank card every month up till now. I told them that I had canceled the account and am shocked and disappointed that they took advantage of my auto-pay status.

So now because I didn't have the cancellation reference number, they want to charge me over 300 dollars in bank fees. That's triple the amount they say I owe them already. They are threatening to put the collections agencies on me. Does anyone know what I can do to defend myslef?

Although the person who is complaining did not enter enough information for me to look up his account & refer to it directly, I will try to rebut this the best that I can without specifics.

When a customer cancels their membership with Eroticy, it is done so in one of two ways, both of which are trackable. Either with a phone call to the toll free number listed on their credit card statement or through an email.

In most of the cases that this person is describing, a member forgets that they have upgraded their account & says that they have cancelled a long time ago and have no idea as to why they continue to be billed. When this happens, we ask for the telephone number the person called from so we can verify the call took place or the email address they cancelled from so we can find it in our archives. We also ask for them to forward us any emails they may have relating to a previous cancellation request.

If no proof is found or offered by the customer, we assume that none exists. We respond to & cancel all of our customer requests within 24 hours of receiving the email or telephone call.

We do not ever continue to bill a customer after they have requested a cancellation, as this would be very risky for us to do as a company.

In this case, when the customer did not produce any proof of a prior cancellation attempt and was not given a refund, he then called his bank and claimed that these charges were fraudulant.

As stated in the Eroticy Terms of Service that he agreed to when he upgraded, any false claims of fraud that are reported to a credit card company and result in a chargeback will be dealt with very seriously. We are charged fees from our bank for each chargeback we incur. These costs are passed on to the consumer making the false chargeback claim. We also submit these accounts to a third party collection agency.

I had the same problem with another company, Bally's Total Fitness. Here is what I did. I hired an attorney, paid him money to write the guilty company a letter stating that "these aggressive corporate behavors must stop..." I also kept careful records of the monies taken by them and I took notes on all phone calls. Those are evidence.

Then I found out that I could have had the same thing done dirt cheap. Have you ever heard of Pre-paid legal services?

Their nationwide and their insurance policy covers what I just said plus 60 hours court time if you are sued. It covers you also if you are audited. If you get tickets, you are covered.

So, I bought my legal policy through them and I now have no more troubles like these.

I highly recommend you buy a policy through Pre-paid legal services. I can hook it up for you over the phone. It's only 26 bucks a month.
