eStarland Will not pay customers their cash outs! Chantilly Virginia

I placed an order on eStarland on May 9th, 2014.  Their policy is that they will mail you a check within 3 weeks at 30 percent less than trade in credit (unbelieveably high for an average gaming company).  Did not receive check in that time, emailed customer service, they said they forgot about my order, and will cash out immediately.  They later said they took the case up to their highest manager in this department (lies), on June 6th I finally heard back from them saying this:

We do apologize for the fact that your cash out order has not been processed yet. The head of accounting, the employee who handles cash out requests, has been made aware of the situation and we are working towards having this issue resolved for you as soon as possible.

June 9th after not hearing back from them I got this email:

 

WE do strive to do our best for you and all of our valued customers. We will have this processed for you soon since this issue has been escalated to the highest level employee in the department that issues these checks.

After talking to them once again about them putting me in a new group of people instead of making the payout I get two emails:

 

Email 1:

We thank you for your continued patience as we continue to process your cash out request. Unfortunately we have experienced a higher than normal number of cash out requests lately and this is slightly delaying the processing of your request. We are working on issuing these payments as quickly as we can and yours will be processed in the order it was received.

 

Email 2:

Unfortunately we cannot say. Please rest assured that it will be processed in the order that it was received.

 

Since then I sent multiple emails and not one has been answered.  I have went to BBB, and now planned a meeting with my lawyer about this situation as this is not going anywhere.  I placed the order on May 9th to get a check in plenty of time to use for a vacation that I must have the money for by June 26th.  This will not happen as it is the 25th.  This has caused my many problems as I did what I was suppose to do and this company does not respond back.  I had an incident so bad in 2010, that Dan Majano of eStarland responded to me with this email:

It has recently come to my attention that you have been unsatisfied with your most recent order with us. I have reviewed your video and I can clearly see that the way your order was handled was unsatisfactory.

In regards to the NBA Courtside, we do apologize you received the game in that condition. It is truly unacceptable that a game in that condition was available for sale. As soon as I was aware of this, we held a meeting to review our quality standards and I can assure you this will never happen again. We are sending you another copy of NBA Courtside, this one in a condition we can stand by.

As for the multiple package issue, there was an issue with the shipping department. When your order first shipped out, the shipping department accidentally incorrectly updated your order so you did not have a clear idea of when the second package actually shipped.

Again, it’s embarrassing that so many mistakes happened in the process of your purchase. I’m glad you mentioned your concerns and it helps us improve and continue to strive to provide our customers the best experience in retro gaming.

I take it these people are no longer with the company.  This company needs to be sued by the feds for ripping off customers, not paying on services, and not acknowledging if they have money issues, all they need to do is put a mortorium on cash services.  No shame in that, but shame in they cant learn from their mistakes.
