Ever Home Mortgage Company HAMP Modification Nightmare Jacksonville, Florida
Applied for HAMP Loan Modification in May 2009, investor is Freddie Mac; servicer is Ever Home Mortgage.
Completed all Trial Period Payments, modification got "hung up" in Underwriting, like so many others did. During that time Ever Home Mortgage reports me to the credit bureaus as 120 days delinquent, 180 days and 11k past due. Never did they report me as in a forbearance situation. Reference FAQ 1222 dated December 2009 as to guidelines of how a modification should be handled while it is "stuck in underwriting"
Instead of giving me an Effective Date of September 1st (1st of month after my Trial Completion) regardless of being stuck in Underwriting, they give me a Jan. 1st of 2010. They refuse in writing to correct the delinquency from Sept on. Their representatives "continued to verify incorrect information" despite my continued disputes with the agencies and Ever Home.
I have been fighting this battle for a year now. They charged me fees for property valuation and I should not have been charged any fees.
They sent me letters stating the fees that were charged, the representatives verifying information "because they did not know" (so it seems stupidity is a defense in this) and refusal to correct the credit reporting during delay in underwriting.
Now today I find out after all these months (since Jan 2010) that Ever Home never recorded the modification to the county that I live in. So they are accepting my money and putting it in a suspense account (which is what they did last time) and now are calling me and sending me letters for my Dec 2010 payment as I am being reported once again as delinquent- even though I am not.
I have at least 6 months of credit that has been reported incorrectly for over a year now.
Has this happened to anyone else and what advice can anyone give me. I have written letters to FTC, AG, Senators, Congressmen, Dept of Banking and Insurance, Office of Thrift Supervision (who at least said they would investigate) filed a complaint with HOPE. No one seems to care or do anything about this.
I am not going to let this sit on my credit report for 7 years.

this is an update on my original post.
I fought for 18 months to get Ever Home to correct the negative reporting on my credit report.
Ever Home continued to insist they had serviced my account correctly. I received a letter from them in August of 2011 stating they refused to update retro active back to my Perm Hamp Date. Then in September 2011 I get a letter from Ever Home stating "the customer service reps continued to verify the negative information each and every time on several electronic queries as they were not aware of the Agreement". How can your customer service not be aware of a modification?
I filed a complaint with Dept of Thrift. Ever Home again insisted to Dept of Thrift they did everything correctly in Dec 2010. By March of 2011 Ever Home sends me a letter simply stating they are going to update my credit reporting from September 2009 to Dec 2009 (when they said the HAMP was complete). And all they say is "sorry if we have not met your expectations".
So now my credit has been corrected after their admission in letters that they refused to correct and continued to verify it incorrectly- but this has now caused me a high interest rate on my car which also trickles down to my monthly finances being more than the 31% that the HAMP was supposed to do. I went from a 7.5% interest rate to a 22% due to their incorrect reporting. I now have a debt to income issue thanks to them.
Why is this not fraud if they took 50k of my equity and did not give me the guidelines that I signed for? And I also found out that the Agreement for the Permanent Hamp was altered AFTER it was notarized and sent back. I would not have known this had I not requested my documents to file a HUD complaint. Ever Home added the co-borrowers name that he was there in front of the notary when he was not. The co borrower who gave up his interest in the property to this day does not know they added his name. Why is that document even legal? I read on Internet it is illegal to alter a notarized document in the state of Florida- can anyone verify this? And they filed an altered document as a legal instrument?
Lawyers are telling me I have a pretty good case but damages are small-this HAMP is probably not even legal....
I am going to ask for an independent review of my HAMP modification again.

I have been going through same thing, and now since I have been trying to get help Everhome no longer sends me mail since last summer. I filed complaint with HUD, OTS, FTS, BBB, called Hope. This is all just a joke.
Last January my balance was 4238 and I paid 4800 to Everhome. My balance is now 2200, 2800 disappeared, they have my home in foreclosure and me in default. If you Google them with consumer complaints, mortgage fraud, you will see that they have a history in fraud. My monthly payment is 710.69, but they want me to pay 1100 (since I notified them I was laid off and asked for modification. Copy and scan everything to them. Don't trust them at all since they are very good with their fraudulent behavior. They reported me to the court and I have never missed a payment since January 2010, nor been late. They charge late fees when not late. My taxes and insurance total 3000, not over 4000, and since they took over my loan from Waterfield in May 2006, they have done shady things, and refuse to give me any payment histories or correct escrow. Everhome doesn't like people asking questions and since I send everything via email, they literally blocked my email since I always told them that is not true and my email (even to original co.) are ignored. Letters are ignored and they say only contact via writing (just so they can lie). Call HUD 877-622-8525. OTS was no help since the paperwork they produce must be different. My balance should be paid off, not in foreclosure for 2200. Last year, they kept 600. extra in escrow (statements never sent to me as if there are 2 different accounts and they won';t even tell me what they paid, new balances, amount due to me, right). In almost 30 years, my escrow has never been in hole, but now Everhome claims -1500. This year everything went down but Everhome.
I send payments via Western Union. Waterfield gave credit same day they received, but Everhome claims that sometimes it may take a few days or next week, then late fee of 45.00 (increased 3 to 4 times since they took over, while Waterfield never increased since it is based on 710.69, even keep refusing to cancel PMI and no one cares. Contact the press, since Everhome should be closed down. Calling the main number is also a waste of time, but try everything to fight these people. The President's office.... They mean to steal your home and add as many extra fees in their pockets as possible. These people are crooks and if you can refinance, please get rid of them as soon as possible.
