We contracted with Everdry Toledo to waterproof our basement.  Tim Despoth, the project manager, and other personel convinced us that part of the basement wall was about to cave in.  They had 5 "professionals" from their company assess the wall and then contracted to remove what they said was block wall.  Jim Lambert of Perrysburg is their agent who they use to remove basement walls and foundations and rebuild. 

After Jim Lambert excavated the entire wall, he came to me and and said that "we really have a big problem". The wall was a solid pour concrete wall and he confessed he didn't know how to remove that kind of wall! He said he didn't know what to do. I replied to him, "I am not the professional here."

Even if the 5 "professionals" that assessed the wall prior to the excavation, Jim Lambert would have had to know after several feet of excavation what kind of wall he was dealling with.  It was obviously NOT a block wall even to casual observers.  He should have never proceeded to do something he knew he was not qualified to do.  HE then rented a large gasoline concrete saw and made 2 vertical cuts in the basement wall and tried to knock it over with the heavy equipement.  The wall did not budge.  This was the wall that their salesmen told us urgently needed replacement?

My husband had discussed prior to the work that IF there was to be any dust that there would need to be visquine hung and other protections.  Jim Lambert assured us that there would be no dust and if they used any equipement in the house they would use water to stop the dust.  Jim Lambert spent most of the time bragging about how good he was and how many new homes he had built for his wife. By the time that they had finished the 2 vertical cuts ALL 4 levels of our home was inundated with concrete dust.  Everdry told him Jim had to get it cleaned up.  He call a Molly Maid who never showed up.  That is the equivelant of trying to put a bandaid on an aortic aneurism.  HE needed to call for disaster clean up like ServePro but would not, and offered us $500 to clean it up ourselves.  I told him we couldn't afford to work for .50(50c)/hour and didn't even have the equipement to begin.  We called many cleaning professionals and when they heard it was cement dust they refused the job.

When we discussed the situation with Tim Despoth, he said that the wall was not a problem, that they would just brace the (now greatly compromised) wall and just finish the waterproofing.  We wanted them to remove the wall as they had contracted to do.  They said they didn't do that type of repair and basically we could just void the contract and get another company to do it!  They wanted us to sign a release that basically absolving them of any responsibilty for the dissaster that they created. 

We are now 3 months into the disaster at our home.  Everdry has refused to take responsibily what so ever for the clean-up or to pay for any of our out of the pocket expenses.  Everthing we have touched or used for these last 3 months has cement dust on or in it. We left the home for 10 days after the disaster trying to clean up a living space.  We cannot clean up the dust ourselves because it destroys any hepa filter that is used and other filters just blow the fine dust back out.  We need about $8,000 worth of professional disaster clean-up which Everdry has said they would pay for but refuses to put in an insurance claim or pay any more for expenses we have turned in. 

We still have a huge hole beside the entire side of basement wall.  Jim dug it even lower than the actual foundation of the home.  It fills with water.  We are not out of contract with Everdry so we cannot contract with someone else to rectify the foundation problem.  We have since run into people that had a terrible mess left by Everdry and disastisfied with the work. We have found in having other contractors assess the problem that Everdry over charges and is not well thought of by many in the industry.  So be sure to shop around.  They do excel in the sales department and we have found them to all be slick liars from top to bottom.

Oh,... This might be the reason that we had NOT heard of Everdry offering any options for help on our construction disaster up mess.  It was sent, not to us, but to our lawyer on December 29th.  The first we saw Everdry's latest offer was their rebuttal post on December 18th. Our original report was made in November.  This came 3 and 1/2monthsafter the disaster and this is only to make them look like they are willing to do something! At this point all we had received from Everdry was a run around and brush off, putting the responsibility on their subcontractor and his insurance company. Their rebuttal is perfect example of their negligence and lack of integrity.

Just to highlight a few points.

A) The 4 options they speak of in their rebuttal were never offered. They NEVER offered to reduce the cost to waterproof our basement.  They DID say that they wouldn’t charge us for the wall they hacked up and then refused to replace.

B)  Tim Despoth told us point blank, to our face, that they would NOT replace the wall that their sub-contractor, James Lambert, hacked up.  We were told that they refuse to work with any other contractor other than Mr. Lambert.  That really surprised us because we knew of other contractors that had looked at the damaged wall and told us they could in fact take it down and rebuild.  We asked if they could be used.

C)  EverDry never gave us the name of their insurance company.  In fact, I’m not sure EverDry is insured.  They want their sub-contractor, James Lambert, to run the damages through his insurance company.  His insurance company told our lawyer that they DON’T OWE US ANYTHING because our contract is not with James Lambert.  Our contract is with EverDry.  We have gone round and round with EverDry about this point

D)  the release of contract we received from Tim Despoth is a joke.  All it does is RELEASES EverDry from any responsibility for ANY DAMAGES that they, or people working for them, have caused and ANY COSTS that we have & continue to incur, due to the negligence their company has demonstrated in failing to adequately supervise or train those who do their work for them.  Everyone that has looked at it including 2 legal departments just laughed and said that it was worthless (not to mention the misspelled words)except to let them completely off the hook.  If you notice it states "Wood County Insurance Agency will be responsible for".  This is not their insurance company!!!!  I think they have run this scam before and that is why there are no bad reports on them.  If we had signed it we wouldn't be able to even write this report.

E)We have called back each and every time that they have contacted us.  But, them saying this makes us look like the negligent party.  The last time they contacted us, I called to tell them that they would have to talk to our legal counsel and gave them the information.  After that and this report along with other  reports that have gone out, they now want to act.  Of course, we have no confidence in them and know that if their lips are moving they are lying.  I wouldn't want them to work on a doghouse of mine.  It has been over 4 months of living in construction HELL and much wasted effort trying to get EverDry to take some responsibility.  If they are so eager to make things right why have we not seen ANY $ from this company for the costs we have incurred?

We wish someone would step up to the plate and take responsibility for these damages, but that must not be EverDry's way

(We are trying to attacch files with the Dec. 29th proposal that our lawyer received and the Release of contract from September, the Ripoff site is not responding.  Will update soon with this evidence)

Everdry would like to get this resolved. Everdry has made many attempts to contact the customer with no response.  In September the customer was offered 4 options and has not been in contact with Everdry to resolve the situation. The Shorts were interested in a release of contract which was faxed to them on September 12th for review. They were also offered the four options below.

Options:

  1. Brace existing wall with steel beams, Everdry to waterproof basement at reduced price
  2. Everdry to hire sub- contractor to rebuild wall, Everdry to waterproof basement at contracted  price
  3. Customer to hire sub- contractor  for the wall of their choice, Everdry to waterproof basement at reduced price
  4. Insurance company to pay for dust claim and customer to void contract with Everdry

 

Everdry has forwarded all information provided to the Insurance Company re the dust.  This is being handled by the Insurance Company. The insurance company has offered the Shorts a settelmant to cover cost and they have not accepted it.

 

Everdry has not halted or delayed the work to be performed on the property.  We in good faith started the job with no down payment and no money has been exchanged.  Everdry has been in business for over 25 years and has over 14,000 customers.  We stand behind our work.  Everdry is looking forward to meet with the Shorts to see how they would like to proceed.
