Complaint Review: Exclusive Auto Imports

Exclusive Auto Imports Misrepresented vehicle, fraudulent, deceitful, lying Pompano Beach Florida

The 2005 BMW M3 that I purchased was described on the company's website, as well as emails from the CEO Jonathan Angel, as having no rust or subframe issues. Immediately after the car was delivered, my local BMW shop inspected the car. The car is full of rust and has subframe issues. The car was grossly misrepresented, to a point of committing fraud. When I contacted Jonathan Angel about the misrepresentation of the car, he refused to do anything about it.

Updating my previous report regarding Exclusive Auto Imports.  The seller of the vehicle, Jonathan Angel at Exclusive Auto Imports, has addressed my concern to my satisfaction.  He was easy to work with and I consider this issue closed.

I gave the seller the option of addressing the cost of repairing the crack in the rear subframe and issues with the rust. Of course I received no response. I have purchased over 50 used cars in the past, so I have plenty of experience when it comes to expectations of a used car. What I don't expect is a dealer to fraudulently misrepresent a car. Seller, how do you explain the rust when I emailed "Is there any rust under the car? I see that it has spent most of its life in Illinois" and your response by email was "No rust." Click on the flickr link below to see pictures that were taken 2 days after I received the car. Seller, do you see any rust? https://flic.kr/s/aHskvg4kp2

Customer Attempts of Extortion and Harassment

#6REBUTTAL Owner of company

Just over 2 weeks ago, Mr. Wallace purchased a 12-year-old BMW (VIN: xx664) with over 121,500 miles "As-Is" for roughly $3,500 BELOW current market value - over an 18% reduction from our asking price. It was very accurately described in an extensive advertisement containing 75 detailed photos of the vehicle. Over the course of the week from his original contact regarding the vehicle, we attempted multiple times to reach him via phone to speak with him regarding the vehicle's condition and possibly provide any other information he may need to make an educated purchase. For over a week since his first contact regarding the car, he absolutely refused to answer our numerous phone calls or return our voicemails via phone to speak in detail regarding the car and left it only to text and email stating that he had been “on other calls” when we had tried to contact him via phone, yet we never received a phone call back prior to the sale.   He did not pick up and did not return any voicemail messages to discuss the vehicle - only texts to discuss price.

As with all of our sales, we prefer to speak to our clients over the phone to discuss specifics of every vehicle, the sale process, and answer any questions or address any concerns a buyer may have. At this point, the conversation usually allows us to judge if the buyer would benefit from a Pre-Purchase Inspection. Mr. Wallace made it very clear that pricing was his main concern. He was offered a heavily-reduced price on a very good condition and rare vehicle.

Only after he examined the 12-year-old used vehicle nit-picking any possible item, did he contact us via phone. The only phone call we received was for him to threaten a lawsuit unless he was fully refunded for the vehicle and transported at our expense and to threaten numerous online complaints and negative online reviews, which, up to this point, have been wildly slanderous.  In reference to his comment that we "refused to do anything about" the situation, he gave us TWO OPTIONS: refund him completely including cost of shipping and pick up the vehicle from him at our expense, OR face a lawsuit and a plethora of online negative reviews. Given that he gave us two choices with absolutely no middle ground and went straight to threatening suit, we are ultimately forced to deal with some negative reviews from a completely unreasonable customer that fully expected to go back in a time machine to 2005 and have a brand new condition BMW delivered for 1/6th of its original selling price....

We are truly sorry he is disappointed with the vehicle that he purchased, and had he been more reasonable with his requests and come to us in a less-aggressive manner, we would have been more than happy to assist him to the best of our abilities. It is our #1 priority at this dealership for the customer to be happy with their purchase and we will do everything in our power to do so. Our policy is to take a detailed walk-around video of every vehicle we sell prior to loading the vehicle onto the transport; this helps to defend against truly unreasonable customers that attempt to harass, extort, and blackmail this honest dealership into cash refunds based on the threat of online reviews. Here is a video of the vehicle prior to loading the car onto the transport truck showing a working battery, no check engine light, and no other mechanical issues at time of sale. Feel free to make your own assessment of this vehicle's condition.

Jim, I have purchased over 50 used cars in the past, so I have plenty of experience when it comes to expectations of a used car. What I don't expect is a dealer to fraudulently and grossly misrepresent a car. I emailed "Is there any rust under the car? I see that it has spent most of its life in Illinois" and the dealer's response by email was "No rust." Never had an issue with complete misrepresentattion.  A few cars that were questionable in the seller's condition assesment, yes, but this is fraudulent.

First, you send off your money to somebody you don't know for a dumb, stupid USED CAR you've NEVER seen!  The "wisdom" you applied is to buy this thing based on pictures, a voice on the other end of a phone and words printed on a computer screen!  Then to top things off, you take the highly intelligent step of having this thing inspected AFTER the deal is done!  I'm impressed!  Yes sir, the ole' tongue was hanging out at least a foot all for some dumb, stupid car!

RIP OFF HERE -- Complainer failed to use common sense.  Seller took advantage.
