Fairbanks Capital Corp aka WMC Mortgage aka Loan Servicing Center ripoff the business that doesn't give a dam Jacksonville Florida
I am writing on behalf of my elderly mother who has the misfortune of having a mortgage being held by Fairbanks Capital Corp aka WMC Mortgage aka Loan Servicing Center. In June 2002 they put a forced placed hazard insurance on my mother's loan, despite her having mortgage insurance and we sent them proof of it. She didn't find out, well shall I say I didn't find out about this mess until August 2002 and ever since then I have been fighting these people to straighten this mess out.
First of all I have sent 6 different faxes where my mother is giving my authorization to handle and speak on her acct, they have not one showing on there where I am authorized to handle her acct. Every month my mother is sending them 878.71 on a 88k loan @11.50% interest, what kind of crap is this??? Since June they have been taking her money 878.71 putting it in a suspense acct and waiting till the next month to take that money and then apply 1214.00 to an escrow acct, where they say they have paid some property taxes.
Ok fine, but when I tried to get them to work with her on setting up a repayment plan and after promises of them doing so it hasn't been done. According to our records we only owe Nov and Dec payments, but yesterday we got a letter from an attorney saying they have put the house in forclosure, they are wanting almost 5700.00 and when I ask where they got these figures I get no answer or explanation. HELP what can we do to save her house? She can't afford an attorney, really and I have tried everything in my power to help her. I am in the process of seeing about getting a refi for her, but I have to act fast as they are looking to steal her house.

Well, the forclosure on my mothers house has been stopped,I even went to the courthouse on Feb 4 to make sure that the house was not secretly being forclosed on, I DON'T trust what these morons say.The mess has still not been straightened out.
We have been waiting for weeks now on a so called payment coupon so my mother could pay the escrow account, where they paid the property taxes. She is still sending her payments be certified mail where they have to sign for it.
Our attorney called the general council of WMC Mortgage and then from there it went down the chain of command.
Apparently the lady who was responsible for sending the "coupon" out from the escrow dept caught royal hell from the general council, LOL she told our attorney she caught hell from the attorney general, so hopefully these goonies will get this straight. Thank god for good attorneys! I will be joining the bandwagon as well on Sunday!

I also learned on that Fairbanks is an unsupervised lender on HUD?HMmmmmmmmmmmmm seems to me that needs to be CHANGED?? Also contact you local media and radio. One person I am thinking about contacting is Clark Howard http://clarkhoward.com/ he does a radio show and is a pretty smart man. The more people we make aware of this company and hey you LAWYERS! PLEASE HELP US! I am a prelaw student but can't do a darn thing with out that law license!!!

If you don't have an attorney or can't afford an attorney, please check to see if you have Pre-Paid Legal within your area. You can join them for as little as $25 and you will be able to get whatever legal aid you may need. However, you do need to check to be sure they have a real estate lawyer in their group. The other is call legal aid. Better still, call or write (certified) to your state Department of Finance and Mortgage. Send copies of whatever documentation you feel will prove your problem. Hope you find some help.

I am going to be writing letters to the GA,FL and UT state attorney generals office on Fairbanks Capital as well as to the Federal trade commission. I urge you all to please do the same. I just got lucky and found a mortage history report that I sent off for in October. I asked for one the other day and they told me it was a 50.00 charge to send one! This company MUST be stopped!
