We received a 2nd mortgage from Equicredit. In April I received a statement from Equicredit and in May I received a statement from Fairbanks. When I called Fairbanks, they said since I fell behind in my payment that they foreclosed on our house. I have not received anything that would indicate that our house was foreclosed.
They didn't contact the first mortgage holder and didn't inform us. I sent a payment and a letter with the May statement and asked to please contact me to let me know what I was behind so I could make arrangements to get caught up. They cashed the check in June and never got back to me. I sent another payment in June after they cashed the May payment. They sent this payment back. When I called I was told to vacate the house that I no longer owe it. I

hired a lawyer and he wrote to them and explained what had happened. They wrote back on August 5th and told him that the house has not been sold or foreclosed and to contact a Trinia Lilly to set up a forebearance plan.

I call her, she said that she didn't handle that type of work and would e-mail my name and number to Kathy Leato and that she would be in touch with me. She called at 12:45 on 8/14.

I returned her call when I got home from work at 3:30. I received her voice mail that said she was out of the office until the 19. I called on the 19th 21st,30th. 9/5, and 9/16. She has not returned any of my calls. I called the women who wrote the letter and she has not returned my call.
On Sept 13, I received a letter from National Foreclosure Services and was told to call them and not make any more payments, that they are a authorized representative for the owner and they want to negotiate voluntarily vacating the property with the possibility of compensation. I called them to see who they were and they didn't return my call.

I don't know what to do. I'm still making my 1st mortgage payment. They have not been contacted and say they are the 1st mortgage holder and that the 2nd mortgage holder can't sell the house. Help

FINALLY GOT A HOLD OF SOMEONE AT FAIRBANKS

I finally was able to talk to someone at Fairbanks and set up a forebearance plan.



But guess what they will not send me anything in writting that we have a agreement and when I get caught up my statement will be sent again.



In the meantime, I have the word of the man I spoke to on the phone that if I send Fairbanks $2000.00 and send $500.00 each month until we are caught up everything will be fine.



I would not be so far behind if it wasn't for them.
