Here's an update on my lovely situation with Fairbanks...
I had written everone I could think of about this company. I did get a response back from the Comptroller of Florida and the Better Business Bureau. (not so much from the BBB) Anyway, they gave Fairbanks 30 days to respond to my complaints and wanted copies sent to me and them.

Well, I did get a response from Fairbanks. Let me quote a little of the letter I got from Fairbanks (which was sent to the Comptroller also) and you tell me what you think... [quote] The due date of this loan is the 1st of each month, with a 15-day grace period. I have requested a total of $45.40 of paid late charges be reversed and added to the suspense account. Mr (our last name) can send a total of $136.23 to be added to the suspense amount of $45.40 to be applied to the February 1, 2003 payment. I also waived a late charge in the amount of $9.08 that was assessed on the loan January 16, 2003.

I thought "FINALLY...something was done!!" Well............ you should never expect anything good from Fairbanks. We paid our February payment on time, paying the amount we were told to pay by the letter quoted above. We just got our monthly statement for our March payment and it shows our regular monthly payment due, PLUS $45.40 in late charges due. So, as usual, I called Fairbanks. This rude idiot (Kenny)tells me that the charges WERE reversed, but were reversed BACK. That the letter meant that they would only reverse the late charges (which by the way I proved we DIDN'T owe) to help us make the monthly payment (what a joke) and they were reversed back after the payment was made!! The $9.08 January charge was WAIVED, not reversed. There is a difference I guess.

So this whole letter was just to try to make the comptroller happy, thinking that Fairbanks realized that they were wrong and were making things right. They aren't. So I ask this Kenny..."When I make my March payment, are you going to take part of the payment to pay these late charges that were reversed back on my account and put the rest of my payment in suspense, which would then show me as NOT paying my March payment?" He said no, that is not how they do things. That's a bunch of bull there. They did it before and I told him that. He said it wasn't true. (so now I'm lying when I have a payment history showing exactly that) I asked him if he could guarantee me that they wouldn't do that. He said no. So I said that it would probably happen that exact way then. He said no. I said "guarantee me." He said he couldn't.

So now I'm going to have to pay these late charges that were reversed BACK ON my account or else they will start showing me in default by applying my monthly payment to the late charge and putting the rest in suspense. I am writing the Comptroller back again tonight. There were other problems with this letter that was sent and I need to address those too. They stated that they only did ONE Property Inspection in which we were charged for. I have proof that they did TWO. They said they had charged me Interest on Advances (which they say is money advanced by Fairbanks to pay the borrower's obligations per terms of the mortgage, such as property taxes and insurance). I DO NOT have my taxes and insurance escrowed through Fairbanks! What money did they advance me and what did they pay????

This company is nothing but a joke! A complete joke! And the people that work there??? Oh my....my 10 year old could do as well of a job as them. They usually have NO CLUE what they are talking about and what is going on with Fairbanks. How do they find these employees??????
So, after a few brief days of joy, thinking that a wrong had been righted, I'm back to square one with this company. Trust me what I say I know how the rest of you feel. It's very frustrating!!!!!!!!
