I too am a victim with this company. It's sad that these are Americans ripping off other Americans just for the greed of money. Fairbanks just three weeks ago assumed my mortgage from my previous lender. They tell me I'm three months behind already.

I've always paid my payments and have proof with my bank statements. They told me to fax it to there research department. By reading other what has happened to others, it appears I'm in for a BIG headache. Has a class action suit been started. Please feel free to e-mail me with any help. I'm just an ordinary guy with a family making it pay check to pay check.

We did what everyone suggested. RAN for the nearest lawyer, actually THREE!!!!! None had heard of this company and they kept sending me from one to anotherwith the only suggestion was to send payments certified mail, return reciept and to refinance. one of the lawyers called a morgage company to ask them if the had everheard of this company and they said not since the day before when a couple walked in terrified that their house had been forclsed by fairbanks. i told the mortgage company to give them our number so we can fight this together

Yesterday I called into a radio show called LET ME SPEAK TO THE REALTOR and I told them about Fairbanks AND THEIR scams!!!!!!!! they had never heard of them either. I GAVE OUT THIS WEB SITE SO PEOPLE CA SEE FOR THEMSELVES!!! WE WERE FLOODED BY PHONE CALLS WANTING TO KNOW MORE.

Yesterday I went to a appreciation luncheon for our local legilators ' I made up folders with copies of the RIP-OFF REPORT letters AND GAVE A FOLDER TO A MEMBER OF SENATOR TEEL BIVINS , to REPRESENTATIVE DAVID SWINFORD and REPRESENTATIVE JOHN SMITTHE who is on the committee overseeing home insurance practices.

They both agreed to read it and see that it would be brought to the attention of the ATTORNEY GENERAL'S office. There is nothing like going straight to the top and if you can do it in preson so much the better.

we have started refinancing of our house before our credit is reuined by Fairbanks and their scamming tactics. Do something! anything !! EVERYDAY!!. DO NOT TAKE IT LYING DOWN. EVEN IF IT IS ONE PHONE CALL OR AN E MAIL IT MAKES ME FEEL LIKE I AM DOING SOMETHING TO HELP NOT ONLY OURSELVES BUT SOMEONE ELSE IT TAKES THE POWER THEY HAVE OVER US THE CONSUMERS AND PUTS IT BACK IN OUR CORNER!!!!!!!!!!!!!!!!!!!!!!!!

When it ages out to that point, usually the homeowner will find themselves "sold out" to one of these so-called "servicing companies from hell". These companies are "non-banks", so they are not subject to much Federal oversight at all; everything is a civil matter, meaning that the consumer has to foot the bill for attorneys and legal costs.

BEWARE: some of these servicing companies are actually nonbank subsidiaries of the original lending bank! Meaning that the company was created specifically to escape Federal oversight; that in itself should tell you something.

The shame of it all is that there seem to be so many uncorrectable errors made during these transitions. As in your case, you found yourself "behind"...BULL! Most of these servicing companies are "subprime", meaning that they deal with folks who have lower credit scores. I still have a sickening suspicion that these errors are purposely created in order to get rid of the loan so that the original lender can make more loans at higher rates and start collecting interest again.

I bailed on Conseco when I started reading posts here that they were beginning to act a lot like a company in trouble. I had weathered the change from GreenTree with no problem, but I could smell
yet another sell-off coming. With only five years left on my mortgage, I was terrified that I would wind up with (take your pick of any servicing company on this site), so I went to the local (meaning state regulated; not a national bank) and they agreed to finance the rest of the term of my mortgage. Whew! Saved by the Ripoff Report!

Perhaps you can try that as well. Take your receipts as proof that you are not behind and as many of these ripoff reports on Fairbanks as your printer will print and explain your situation. Do whatever you can to get away from Fairbanks. Don't walk; RUN!!! They are destroying your credit even now in order to make it almost impossible for you to refinance.

We too have been ripped off by this VICIOUS MORTGAGE company. Our mortgage was sold to FAIRBANKS CAPITAL CORPORATION by HOUSEHOLD FINANCIAL SERVICES.

They were sold our mortgage by FIELSTONE who bought it from the bank we trusted AMARILLO NATIONAL BANK.

we have had nothing but problems with them such as them adding forced insurance though we have faxed them several times with copies od our insurance . they still claim we don't have insurance. last week was the last straw. we recieved a letter claiming that because we filed bankrupcy they could no longer provide us with our loan statments and to send our payment to a diffrent address. problem is !!!!!!!!!!! WE NEVER FILED FOR BANKRUPCY!!!!!!!!! and because they claimed we signed a form stating we didn't want a grace period our payment has to be there by the 1st or we get charged a late fee ! PROBLEM IS WE NEVER SIGNED ANY SUCH FORM!!!!!!!!! I keep asking them for a copy of the form they claimed we signed and they refuse to send it. i sent in my payment to the address on my MARCH DUE STATEMENT . NOW THEY WON'T ACCEPT MY PAYMENT.
WE FOUND THIS SITE BY ACCIDENT AND THANK GOD WE DID!!!! I STARTED SHAKING I WAS SO ANGRY WHEN I READ HOW HORRIBLE THEY HAVE TREATED HUNDREDS OF PEOPLE . WE HAVE OUR OWN TALIBAN IN THAT MORTGAGE COMPANY.
WE WENT RIGHT AWAY AND TALKED TO A LAWYER AND THEY ARE REVIEWING THE RIP OFF REPORT COPIES WE TOOK THEM TO SEE IF THEY WILL TAKE THE CASE.
I CALLED OUR STATE SENATOR TEEL BIBINS AND HIS OFFICE GAVE ME THE NUMBER IN AUSTIN FOR GREGG ABBOTT OUR NEW ATTORNEY GENERAL. THEY IN TURN TRANSFERRED ME TO THE CONSUMER PROTECTION OFFICE. THE NUMBER IS 512-463-2173. THEY ARE GOING TO SEND ME A FORM TO FILL OUT OUR COMPLAINT. OR YOU CAN GO ON LINE TO www.oag.state.tx.us. I hope this information will help you . If Fairbanks is claiming you are 3 months behind on your mortgage then you NEED to assume that they will proceed with FORECLOSING on your home any day!!! The fact that you have never missed a payment and that you can prove it, doesn't matter!! Please retain a lawyer TODAY!!!!

Call your State Attorneys office, call the FTC and file a complaint 1-877-382-4357. You need to stay one step ahead of them. If you can refinance, do it.

Many, many people have lost their homes, or filed bankrupcy. Many others have been forced to pay thousands of dollars to Fairbanks that they did not owe in an effort to save their homes.
Be prepared, you are about to go on the ride of your life.

There are over 600 lawsuits across the Country against Fairbanks Capital, many are class action suits. Do your research and find one in your area.
