Fairbanks Capital Corp, Loan Servicing Center Fairbanks Loan Servicing Center Ruining our Credit ripoff Nationwide
Our Loan was sold to Fairbanks from Ocwen. We were informed of this in November 2002. We never received a letter informing us of the change.
Ocwen was still taking our payments atleast as of September 2002 because we had contacted them to inform them that our payment would be 2 weeks late. Fairbanks claims that they acquired our loan in September 2002. Since then life has been unbearable. They sent us a letter telling us that our loan is 3 months behind. I faxed them cancelled checks and they have not credited our account. I spoke to one of their employees who informed me of signeing a FORBEARANCE AGREEMENT. She said that once they received the fax it would be credited and all would be well.
We signed the agreement in November 2002 and now they want us to pay a bit over $8,000. We made all the payment as agreed. They added insurance to our payments of $174 monthly. Our home insurance company has faxed them a copy of our policy several times. But Fairbanks is still charging us insurance.
I have called 4 times in 9 days and have not received a call back. I have spoke to Melanie H., Veronica M. however, I have been told that my file is now with Dianne P and I have left her 4 message and no call back.
We just like all of you do not want to loose our home. Is there any way that we can get together and take this company to court?
We have a good amount of equity in our home and we cannot get a loan because they have us as 5 X's 140 on our credit reports. Veronica informed us right before we signed this forbearance agreement that it would not effect our credit ratings and would keep out reports from looking bad. It did just the opposite. I now have started digging deeper since we have been trying to refinance (though no company would dare touch us) we found out that there is some company who has inquired about our credit 42 times in 3 months. We think it may be Fairbank and we are going to find out real soon. Who else would check out credit we have not applied for any credit cards or anything and just looked into refinancing mid April.
So, now we just don't know what to do. We really can't file Bankruptcy because we don't have much at the end of the month to make payments. And it seems that this company doesn't care if you file or not.
Anyone know a mortgage company or Broker that works with bad credit and foreclosure? Gee Whiz this is awful.
Did any of you get the Video from the Loan Servicing Center? I am sorry that we signed that agreement and this whole mess that we have got into. I am determined that I will do all that I possibly can to save my home. My husband is working so much overtime I hardly ever see him and commutes 70 miles. I am looking for a job and Daycare for our daughter at the same time.
How can we shut this company down? What can we do to save our homes? Please contact me with any suggestions or if you are interested in taking this company to court. There is strength in numbers.
