They have screwed up so much it's hard 2 know where to start, but it's a relief to think there are other people that our also suffering under FAIRBANKS' lack of Customer Service. Let's do something about it.

This is my Mother & Deceased Father's loan. Mom BEGGED for Monthly statements as proof of Fairbanks receipt of loan payments. My brother tried, my sister tried & I tried, they needed my Dad's written OK to talk to us. His Death Certificate didn't help ! Since April of 1999 Mom has rec'd 3 yes only THREE statements but they only show next amt. due, not the distribution of the previous payments.

I took over making the payments in 2002 when Mom became ill. In Sept. 2002 Fairbanks sent a letter lowering the payment to $204...it's an Adjustable Rate Mortgage. We sent the requested $204. in Oct 2002 which they put in a Suspense Acct. because the $204 was only enough for Principal & Int. Their letter failed to include the Escrow Payment in the NEW loan amount!!

Of Course Fairbanks did NOT INFORM us of the shortage nor that they put it in Suspense instead of applying it against the loan. We were charged a late fee. In November 2002 I used Speed Pay & was told the previous payment was short. So, I authorized an amt to cover the shortage & Nov. payment. He wrote down an incorrect Bank acct number; the payment was rejected by the bank. Once again Fairbanks did not tell us.

I sent the December payment which Fairbanks refused since the loan was going into Default. On January 4, 2003 we rec'd a Default Letter; on January 28 I was served with Foreclosure notice. I am not listed as a Borrower on the Loan and my Mother was not served since they are unaware of her address.

The Legal fees that they now are adding to the loan balance are outrageous, even included Service of my Mother which did not occur. To stop the Foreclosure I agreed to a Forebearance. Doesn't seem Legal since I am not on the mortgage.

In July 2003 I was late 4 days with a payment and we are back in Foreclosure. In signing the Forebearance I gave up all rights to fight the Foreclosure in court.

My parents Home is scheduled to be SOLD on October 1st. Any Ideas on how to prevent this ?
