I am like all of you who have come before me. There's no need to report the same outlandish fraud. Charging erroneous fees, not sending payment notices. However, my beef with them currently is they charged me a prepayment penalty when I sold my current home and bought a new one. The paperwork we singed boldly staes they CANNOT charge a prepayment penalty in the event the property is sold. Not to mention it is illegal in the State of Minnesota to charge a prepayment penalty when you sell your home. Thank God I am now away from them and my mortgage is with a local bank, but I am bound and determined to get that $1440 back from them.

I have played the phone game, got a supervisor who no one knew the next time I called. Made up person I beleive?? I asked for executives names, wouldn't give me that information nor would they give me their extension so I could follow up with what they were telling me(That's thier policy) Makes sense, wouldn't want you being able to talk to the same person twice! Defeats the run-around.

Anyway, I have faxed all the signed paperwork showing they cannot charge the prepayment penalty and was sent a letter saying basically "too bad, we have every right". I called and got the so-called supervisor by the name of Vincent Vervalde who claimed he would personally call me back within 24 hours. He knew the person in the payoff department that had handled my appeal and he personally talk with them. Yeah right!! I faxed it all again, called back and got someone else, Deanne Johnson, who claimed to be in the executive response unit. SHe had no idea who Vincent Vervalde was...I asked her what her fax number was, she told me, it's the same as Vincent's. SHe put me on hold to go check the fax machine for my previous fax, and came back and said "Vincent didn't receive your fax, you will have to fax it again". I said I thought you didn't know who VIncent was? SHe said she found him on the way back from the fax machine????? Good answer! I faxed it all to her again and have not received a thing form them. That was on 11/26.

I call daily and ask for a status. I spoke to a gentleman today who told me I would receive a phone call back tomorrow at the latest directly from the payoff area regarding this matter. Please. Not holding my breath.

I wanted to share this link with all of you!! This is the link to the comptroller of Florida's Finance department. This is the agency that licenses and regulates these losers!! If we all complain possibly they will get the idea. You can complain online via email!! Everyone go now and send them your stories! WE have to bring these people to justice. I also reccomend that you cc: any correspondence you send Faribanks whether it be email or letter to the Finance department. Everyone should also contact the attorney general in your own state, as this company is preying on all vicitms from every state and I doubt that your attorney general will take kindly to FLorida's or Utah's or NJ's attorney general not doing anything about it!
