Increase payment amount, without explanation. NOTE THAT the defendant, has contacted the representatives at Fairbanks Capital Corporation on numerous occasions to inquire on stated issue, both by phone and fax without receiving any understanding response and/or correspondence directing explaining the issue, until the second week of May, 2003.

ii. Issuing statements for the same months that have already been paid. NOTE THAT the defendant, has contacted the representatives on numerous occasions to inquire on stated issue, both by phone and fax without receiving any understanding response and/or correspondence directing explaining the issue.

iii. That during the above telephone conversations, the Defendant was informed to make correction(s) on the payment slip and submit the stated amount in the note, for payment. NOTE THAT the representative refused to give there full name, employee number and/or any other form of identifying the representative spoken with that advised the Defendant.


iv. Withholding payments made and received, knowingly and willfully creating a situation for their benefit, to have the Defendant incur late fee's.

v. Charging for insurance(s) even through documentation have been


vi. repeatedly sent showing the property is properly covered.

vii. The Defendant incurring additional payments/fees in which Fairbanks Corporation cannot justify and/or give explanation for or accountability for.

viii. Failing to credit payments received in a timely fashion.

ix. Failing to provide customers with timely or clear information about timing and amount of payments owed

x. Prematurely referring accounts to Fairbanks' collections department after loan payments become due, regardless of legal and contractual grace periods

xi. Misapplying payments received
