Fairbanks Capital Corp took over our mortgage April 1, 2002. By November, actually the week before thanksgiving, they filed foreclosure....you see, since you only have 10 days to respond, and there's a 4 day weekend, it cuts your response time down.

I filed my response, showed my payments and the foreclosure was stopped. A few months later, I received a letter saying they were going to foreclose, so I called and they said I hadn't paid the legal fees from the foreclosure and until that was paid, I could be foreclosed upon again, so I filed bankruptcy.

Not that that did any good.... they filed ( and got) a release from stay which means they don't have to abide by the bankruptcy laws of your state, and they can try to get your property again.

Through all of this we have NEVER EVER gotten a call from anyone identifying themselves as Fairbanks or asking if there was a problem..... now they're sending the payments back, so technically their records show I'm 90 days late... when i called them to see why they were sending the payments back, they told me I needed to "take a more proactive approach" to my account.... how much more proactive can I be than mailing
my payments. I'm getting nowhere with my phone calls.. one number they gave me to call was disconnected, the other number the office is closed...

This company is horrible... even though in my heart I know they can't take my property when I can prove thru copies of everything that I'm trying to make my payments....I'm tired of having to spend every day battling this horrible excuse for a mortgage company. Something has to be done!
