I knew something was wrong when my previous mortgage company Temple Inland advised me of my new mortgage company and before I could get a payment off to them I had already received a letter from Fairbanks that I was 90 days delinquent!!! I was never late with my previous mortgage company and now upon transfer I was 90 days late??!!

This was in late August 2002, in December 2002 I noticed a discrepancy in my statement (thank God at least I was getting them) so I called and they said they had charged me a $150 corporate administration fee plus $.12 interest due to my payment being late!! But it showed right there on the statement that I wasn't late?!On December 27 I mailed them a letter requesting this to be investigated. On January 6 I got a call telling me that I needed to make my payment.

When I questioned her she checked her computer and found that the Jan 1 payment had been posted 100% to principal on December 30. I told her that was not my error!! Her supervisor came on the phone and told me I better pay up! I told her I was going to do something about this fraud being perpetrated. I soon received a letter quoting RESPA and the need for 60 days to investigate this discrepancy.

After reading all the reports on this website, I think they are just buying time to try and foreclose on my property. Just today I received a delinquency notice in the mail. Phone calls and letters don't fix anything, even them seeing it in their own computer screens, it doesn't seem to sink in. Please, if anyone out there is considering a class action lawsuit against these jerks let me know, I'm in!!

I sent my complaint to the California Attorney General, and all I got back was a form letter that they freakin' APPRECIATE MY CONCERN!!!!

I am in the loan biz. I work for a lender, and I did my own employee loan! And I paid 2 - 3 weeks IN ADVANCE. When my own company sold my loan to fairbanks, I was not only paid ahead, I was already 3 weeks into a refi. Fairbanks rec'd their payoff (per THEIR demand) on 12/26 (next payment due 1/1/03. On January 10th, I rec'd a NEW demand, sent to MY HOUSE, saying they had added a prepayment penalty. The date of the letter? 1/6/03.

I made call after call, and rec'd the same horrible treatment you all did. I was asked over and over for payment, even though they acknopwledged they had rec'd a payoff! I had to make a payment, at the end of January, or they threatened to show me late on my mortgage!

Friends, I contacted each lawyer showing interest on the net, and all I got back was `thank you for your concern", and , `would you testify'.

Here is some VERY SOLID ADVICE! I am in the business, and I can help you.

PAY BY CHECK ONLY! (Fairbanks will actually hold pay-by-phone payments until you are late. Not only that, they will charge you $15 when the actual cost is $5. Very illegal for them to gain a profit on pay-by-phone). Send EACH payment by certified mail. They have to sign for it.

While they may threaten to show you late, you have a true track record to present to a new lender when you try to refi. Believe it or not, if you have the proof, most brokers deal with credit reporting agencies that will accept this proof, and can pierce the credit bureaus DIRECTLY and correct the ratings. Thus, you can refi, and get the hell away!

In California you can file a complaint with the California Dept. of Corporations, I did this regarding some bogus late charges they charged me and Fairbanks agreed to credit my account with an amount equal to 5 late pays. They haven't taken the late pays off my credit report though. I doubt they will. This is how they force you into staying with them. Anyway, please file a complaint with Ca Dept of Corporations at: 320 W. 4th Street, Suite 750 Los Angeles, Ca 90013-1105.

You should check your credit report to, it's probably damaged from their fraudulant reporting of late pays.
