Complaint Review: Fairbanks Capital

I was looking for the Fairbanks Capital website when I found your website. I am currently a customer (I use that term loosely) of Fairbanks and formerly of ContiMortgage.

My loan was serviced by Conti then sold to Fairbanks. In 1999 after two years with Conti, we had to file Chapter 13 to avoid losing our home. I couldn't understand how we owed them so much money and couldn't get ahead, now I know.

They charged a late fee every month even though we paid within our grace period and somehow one of our payments disappeared. We are still in Chapter 13 and after checking our account at Fairbanks we have a negative balance in escrow of $3900.

This is for forced insurance and payment of taxes. We had lapsed in our house insurance for a month or two but not for the amount of time they are saying. We also paid our own taxes.

Taxes and insurance were never part of the mortgage payment. I am relieved that we have the protection of the Bankruptcy court but we are close to a discharge. Our credit from this and the bankruptcy is too bad to get a refi. What can I do to get out from under this company???????
