My name is Sylvia Jones and I took a $15k loan out with Citiplatform who inturn sold it to Fairbanks Capital Mortgage Co. I contacted Fairbanks on Tues, March 4 to request a fax of all and any documents regarding my account. As of today, March 10, 2003, I have not received the fax.

They also were unable to pull up any files regarding my account or refer back to any hardcopies. My loan was taken out on 12/24/1997 in the amount of $15k and the first payment was due and paid on 1/3/0/98 and as of March 10, 2003, Fairbanks records state that I still owe $12, 285.47 and that as of today, I have only paid $2,714.53!!!!!!

Making a monthly payment of $200 since 1/30/98 to 3/10/03 makes it a total of 63 months which should show that as of today, I have paid f $12,600!! Please help me save my home that has been in my family for 30 years and 3 generations!
Thanks in advance,

Sandra

Fairbanks - Fraudulent Interest in Payoff balance

#2Consumer Comment

Thu, March 13, 2003

I recently refinanced, horray!!. The past seven years with ContiMortgage/Fairbanks was horrible.

First of all, Fairbanks did not respond to the payoff request which was sent three times by my new lender. On the day of settlement(March 10, 2003,the new lender called me and asked if I could get in touch with Fairbanks and see if I could have them fax it on that day.

I had to send a request by fax and they said it would take at least 24 hours.(this was requested 3 weeks before today). I finally called and spoke with a supervisor at Fairbanks and she said she would have it faxed immediately. She did. But now I get a call from the new lender, the payoff is $4,000 more than my principal balance (which I got off a statement dated March 5, 2003). I called Fairbanks for an explanation and they said the difference was $162.00 in unpaid late fees, $10.00 payment request fax fees, $20.00 processing fees (what ever this is) and $3,599.00 in interest.

I called back for an explanation of why so high and was told that is 30 days at $58.22 per day, (but that only totals a little over $1700) but she said well, that is what the true payoff is. I know this is not correct and that they are doubling what I actually owe. I am glad I don't have to deal with them any longer for my mortgage, but I will get to the bottom of why I had to include an extra $4,000 in my new loan of 30 more years)
