I mistakenly OVERPAID $53 on my July mortgage payment. Being on a fixed income with 5 small children living at home, I wrote them a letter explaining this to them and deducted $53 off of my August payment. They now are trying to charge me $225 extra for a "partial payment". They refuse to send me a bill explaining the reasoning for the extra charges. All attempts at resolving this situation by phone have been met with rude,semi-literate collection agents that agree that I overpaid in July, but that overpayment has been sent to some unspecified fund to cover some further unspecified "fees".In the words of one of these agents "we are either going to get this $225,or we are going to take your house, you decide.

In June,I received a check from Fairbanks for $1400. Upon checking on the reasons for them sending me this money,I discovered that they have been overcharging me over $50 a month for 27 straight months and almost got caught with their hand in the cookie jar by an auditor. Now they are threatening me?What do these guys do,rob 7-11's on their lunch breaks?

I would be interested in finding out what the "overcharges" and "partial payment fee" are. The overcharges may be miscomputed interest on an adjustable rate mortgage, which is the subject of a pending class action against Fairbanks we have filed. The "partial payment fee" is a new one.
