Now that we have received our notice from the FTC regarding USA vs. Fairbanks Capital and Allana L. Curry, et al. v. Fairbanks Capital Corp. Claims Admin Center, c/o Gilardi $ Co. LLC PO Box 808054, Petaluma, CA 94975-8074 for Late Fees/Default Late fees, I am finally sending my report.

I hesitated to send my report in the past for fear of it being used against me in court. So far I have not hired a big law firm but I have been considering it if the FTC doesn't come through for us.

My claim is that Fairbanks has no record of several of our payments and this trouble begain during the 'handoff' stage when Fairbanks acquired large portfolios of mortgages from other companies. Fairbanks had poor communications with us on their servicing procedures thus thay lost records of our payments.

We are currently trying to refinance and I fear this will not be possible based on what I have read here. I appreciate any information I can get on my options and what our next step should be.

It's good to see Uncle Sam is looking out for our American Dreams!

IF THEY PAY YOUR TAXES, LOOK OUT FORECLOSURE MAY BE UNDERWAY, WATCH OUT FOR THOSE FEES

If Fairbanks willingly paid your taxes and late charges without your notification, BE WARE. You will pay in the end. They charge you "ON DEMAND INTEREST FOR ADVANCE FEES", these fees can add up to about $500+ depending. Eventuall you will have to re-pay fairbanks, Look out, if they paid your taxes, you could be looking at the start of foreclosure proceedings. I just came out by obtaining a second mgt. But the fight is not over yet. They still hold primary mgt on my property. Quote from Fairbanks Rep: "THEY CAN NOT START FORECLOSURE PROCEEDINGS, OR INIATE FORECLOSURE UNLESS THE TAXES ARE PAID" BE WARE...

Fairbanks payed our taxes and late fees and sent us a statement. Is this a good sign or not? I'm seeing different stories on this. Will they play fair after the FTC battle is over?
