Complaint Review: Fairbanks Capital

Fairbanks Capital is the mortgage holder on a property that I have owned. Because of certain circumstances Fairbanks offered to release me from the lean on a "Short Sale Payoff". I have documentation from them stating the amount they will accept and in return they will release the lean in full.

Two and a half months later they still have not released the lean. All they are telling me after many phone calls is they will submit the information to their conveyance department. The property is in the process of being sold but it's held up because they also will not supply the title company anything to state the loan has been paid and there is a zero balance.

When I asked for them to send me a letter stating there is a zero balance they say "No we won't do that" They are telling me that I should have the title company call them. Over the phone they will say nothing is owed but other then that they have failed to do anything but yet they took the payoff and cashed the check.
