TO everyone on this site regarding UnFair banks.My husband and i have been dealing with this this company for 2yrs.We finally had to file a chapter 13 and Fairbanks still want leave us alone.on 12/12/02 this will be our 3rd time they have taken us to court to have the automatic stay lifted so they can foreclose on this home,they lost last time and they will lose again,best advice: make a paper trail and keep everything (you must have documentation....) they have refused our payments for the last 6 months (they return them)now they are saying we are 7 months behind,we also have never received statement from them showing where our money is going according to them everything is being held in suspense.It takes a whole lot of money to fight this kind of thing,we have fought this on our own and you can do it with out a Lawyer,you just have to know what to do,if your lucky enough and can afford one, then get one.There are class action lawsuites out there against FB but no one will contact you back.We also have contacted our congress Women and Florida Comptroler,Unfair trade practice division and Washington 3 times,we had FairBanks on our local news in Dallas Texas back in March,02,still nothing.But we are not giving up and don't any of you.We are tired and sometimes giving up sounds easier than this..we do have other avenues (we are thinking about turning our chapter 13 to a chapter 7 and getting rid of them for good not sure what we are going to do yet.We know that we can start over if need be.Keep your heads up....Mel in Texas

chapter 13 to 7 will not rid you of fairbanks
all secured debt remains with you, you only
lose your unsecured debt stay in 13 till you find another solution refinance if possible with a local banker you may have to take a hit monetarily but but for piece of mind it might be worth it
