Fairbanks Capital takes advantages of consumers by misrepresenting themslves, by there lack of posting timely payments which causes late fees to be added, by using payments as other fees and not actual payments causing homeowners to become further and further behind and consume more debt. They put payments into suspense accounts and choose when to post it, sometimes a month later in our case.

There are many problems going on in this company that need to be dealt with over time. But for now Mr.Ozanne my suggestion to you is that if you want to make with good with all these consumers you stop all of your talking and take action. The saying is actions speak louder then words. I would take all these accounts and wipe the slate clean for everyone. Make everyone current so there is no threat or chance of foreclosure and then take the time needed to check into the company and it's policies and ways of doing things, which of course is going to take a period of time.

You are showing all of these unhappy homeowners that you believe what they say, that you are serious about changing things and that you are on their side. Otherwise you are going to keep having more and more people coming out filing complaints, lawsuits and going to the media, politicians and anyone they can possibly think of. I for one will be right there leading the battle. Show the consumers you are on their side and they will be with fighting with you instead of against you.

Media exposure and lawsuits are never good for a company and if the lawsuits are succesful which I think they will be and the media exposure will just get worse and worse as more people choose to fight back and get word that they are not the only ones this is happening to. I would think that you would want to have your name talked about as the one who turned things around, who came in and did the right thing and fought for the homeowners.

That's how I would want to be thought of anyway.

I agree that the current employess of fairbanks need to be replaced. If they could treat people this way in the first place whose to say they wouldn't again. The whole company needs to be reorganized and have a complete overhaul otherwise it is just a waste of time. It's all up to the new CEO as to where the company goes from here. He needs to hear from everyone involved to let him know that we will either be here to help him or if necessary to fight against him. I would think the first option would be preferable.

If I were in his shoes I would want to have the customers of fairbanks with me not against me as I feel the number is getting stronger everyday and will just continue to grow and grow.

Keep the faith, keep getting the word out and putting the pressure on and let's see what happens. There's definately strength in numbers...

Your letter is very well put. My feelings exactly. I think all on here should have their slates wiped clean as well. However, by just changing upper management and us still dealing with the same supervisors and customer reps, I am afraid nothing much can be accomplished. There needs to be some serious customer relations classes taken by the employees of this company. I doubt whether the new CEO and CFO are going to deal with all calls and resolve all issues themselves, they need to get all employees on board to do the right thing. Stop the rudeness, how would they feel if the name of one of their family members or friends foreclosure came across their desk.

This is the best idea to fix the situation at FairBanks I really wish that that really consider this option.

We have been treated so badly by them that this would make it up to us. Maybe some of us would not consider sueing them.

I have been a victim of "Fairbanks" treating me and all of you as a pile of accounts. I do believe that this can turn constructive, Fairbanks took my home on July 1, gave me 1 day to get everything out of a home I had lived in for 18 years and offered no help through the whole thing. I suggest that they sell my home and give me all of the profit from it. I owe them 71,000. and they will probably get 125,000 out of it with a few repairs. They would break even with me if they gave me back my equity that was eaten up with some accounted for fees. I feel that they could get their credibility back if they would personally contact each and every customer and ask them how they can help them. I understand that there are some that are beyond help, but on the other hand there are those who were just a victim of the circumstances and fairbanks are like the payday loans or the car title loan folks...if they get ahold of your loan there is no way for you to keep your home if there is any equity in it. They usually prey on people (like myself) in a getting divorced situation or are a little behind on a bank mortgage and they receive this loan and forget it your credit is ruined from this day forward. My suggestion again is for them to call each and every client and attempt to work with them.
