I UNDERSTAND EVERY ONE OF THE REPORTS THAT I HAVE READ CONCERNING FAIRBANKS CAPITAL. I TOO, AM A VICTIM OF THIS GREEDY, CORRUPT, PATHETICALLY RUN COMPANY THAT CALLS THEMSELVES A "LOAN SERVICER"....

MY TAKE ON THAT IS THAT WHAT THEY REALLY ARE ARE JUST LIKE THE OLD TIME "PROTECTION" CHARGED BY GANGS AND THE MAFIA. I RECENTLY FILED CHAPTER 13 BANKRUPTCY TO PROTECT MY HOME FROM THESE CRIMINALS.... AND I STILL CAN'T SLEEP AT NIGHT AND CONSTANTLY FEAR WHAT THEY WILL DO. SINCE THE BANKRUPTCY WAS FILED, FAIRBANKS HAS SENT A PERSON TO MY HOME TO DELIVER A NOTE..

THAT PERSON WAS TOLD THE FIRST TIME NOT TO SET FOOT ON MY PROPERTY EVER AGAIN... BUT HE HAD THE GALL TO DO SO AGAIN... I AM JUST GLAD MY HUSBAND WAS NOT HOME..... I FEAR WHAT WILL HAPPEN IF THIS MAN EVER COMES TO MY HOME AGAIN .... I KNOW THAT I WILL CALL THE LOCAL SHERIFF'S OFFICE AND HAVE HIM ARRESTED FOR TRESPASSING.. ALSO, FAIRBANKS KEEPS CALLING AND SENDING THREATENING LETTERS..... IS THIS NOT CHARGEABLE CONTEMPT OF THE COURT ... AFTER ALL....

I AM IN BANKRUPTCY.... I DO SEE THERE ARE NOW THREE CLASS ACTION SUITS IN THE MAKING AGAINST FAIRBANKS... AND THANK GOD ONE OF THEM IS IN THE STATE OF GEORGIA.....

I HOPE THERE ARE MANY MORE TO FOLLOW .. AND ALSO HOPE THAT AT SOME POINT THE FEDERAL AUTHORITIES WILL GET INVOLVED.... AFTER ALL.... THESE PRACTICES SOUND A LOT LIKE THE CRITERIA FOR THE RICO STATUTE TO ME.....

I AM JUST A BASKET CASE... I DON'T KNOW HOW MUCH MORE OF THIS I CAN TAKE.... I TRY REALLY HARD TO KEEP THE FAITH AND HOPEE THAT FAIRBANKS WILL BE DEALT WITH QUICKLY AND IN THE SAME MANNER THAT THEY TREAT THEIR CUSTOMERS.... THERE IS JUST TOO MUCH OUT THERE AGAINST FAIRBANKS FOR IT TO BE IGNORED....IS THERE SOMEONE OUT THERE WHO CAN HELP?????????

Regina, if you are in a Chapter 13 bankruptcy, you are protected from creditorharassment by the Automatic Stay which is issued by the Bankruptcy Court when you filed. If a creditor is still contacting you in any way, you should bring that to the attention of your attorney or the Judge if you filed pro se.



By "collection action" the Bankruptcy Court has a very debtor friendly definition. Creditors aren't even allowed to send you a Christmas Card!



In order tp effect ANY collection action against you while you are under Bankruptcy Court protection, the crditor must file a Motion to Vacate Automatic Stay with the Court, and you will be allowed to be part of the hearing and oppose the motion. The standard rasons for a Motion to Vacate include (a) the debtor has not provided adequate protection for the collateral, (b) the debtor's plan is unworkable or (c) the debtor's plan was filed in bad faith or the debt is fraudulent. If none of these are teh case, you should be able to beat back any Motion to Vacate.



Nevertheless, collection efforts outside the Motion to Vacate are Contempt of Court and are punishable by the Court, but only if the Court knows about them.

I feel So bad for all of you this is a tragedy.



i have sent pleas to as many e-mail adresses as i could find to the following companies, HUD, Fannie Mae, Freddie Mac, Moody's, Fitch, Buisness Week, and many other on-line magazines pleading for help for all of you,



i sent the plea to most of these because they brag about them on thier web-site as follows



Standard & Poor's - "Strong" Residential Special Servicer and Residential Servicer, currently its highest rating available in both categories.



Fitch - "RSS1" Residential Special Servicer and "RPS1" Residential Sub-Prime Servicer, currently its highest rating available in both categories. "RPS1-" Alt-A Loans and "RPS1-" Home Equity Loans.



Moody's - "SQ1" Primary Servicer of Sub-Prime Loans and Special Servicer, currently its highest rating available in both categories.



Freddie Mac "Approved Subservicer" and "Approved Special Servicer"



Fannie Mae "Approved Seller/Servicer"



HUD - "Approved Non-Supervised Mortgagee"



i have no idea if it will help anyone in peticular, and i can only hope they view this site, but i dont know what else to do, i dont have a loan with them so i dont believe i can file complaints, but i would contact your attorney generals in each respective state and ill keep sending for more help, i just hope somebody arrives in time for allot of these people.
