Complaint Review: Fairbanks Capitol

Lost my job of 16 years in April of 2000..had my house with Equicredit 1st and 2nd mortgages...began to get behind..tried to make arangements and was told they didn't have to.

Realized we couldn't catch up..and would have to file bankruptcy. Didn't feel right living there..so moved after trying to sell (and Equicredit refused to sell to my buyer).

Per my neighbors, they then sent in a crew to clean up the mess we left the house in. We made sure all utilities were off, the pipes were drained and winterized, we had just finished remodeling with new carpet, paint, fixtures, etc...there was nothing for them to go in and "rip out!!".

They sold the house to themselves after forclosure and we ended up filing our bankruptcy in Nov of 2001. It closed and they were listed for both 1st and 2nd mortgages. All of a sudden we get new forclosures on credit reports (Fairbanks Capital). We were devistated. Called our attorney..He sent out letters but they would remove it and then put it back on. We'l now sue for contempt of federal bankruptcy laws..they have ruined our credit!! This came as no surprise, as when I spoke to the last woman in charge at Equicredit, before I was forced to let my home go..she promised me "you will never have good credit again and we will get your money!"..

well..she wasn't kidding..but I'll be "darn" if they'll continue to hurt us. They actually had the gaul to tell us they didn't have to follow the Bankruptcy laws of Ohio..we advised them that they were federal and they told us our attorney didn't do his job and we still owed them money. My husband and I called our attorney and gave him the what for...only to find he did all he needed to do. So now he will go in on a contempt charge against Fairbanks for harrassment..collection practices on a bankrupted case. And I will forward to him some of the information I was able to get from this web site. I am not sure the FTC Class Action Settlement applies to us..but at least it is more ammo to go after them with.

Thanks to their fraudulant credit reporting..we can't get a car for less than 22% interest, even though others are paying 0%. Everything we attempt to do to get back on our feet they have put a cabash on!! I am even having trouble now in finding a less expensive apartment because they have ruined my credit rating and no one will take a lease from us. And our dream of getting another home is gone.

We are hard working..early 50 year olds. We thought we would be able to get started over after the bankruptcy and health problems...but they are making sure we can't get anything.

But we are tough old cookies..and we are tired of seeing hard working families who are honest and get into trouble because they have helped others in need go thru "hell on earth" because the $$Money Guys$$ can afford to push us around. Well we aren't going to crumble..and it may take awhile to get this done but we will do it!!..and all of you out there can help us with a little prayer to the Almighty for some justice here on earth.
